Construction Equipment Operating Restrictions (Repealed)

The construction equipment operation restriction was an enforceable control strategy under Texas’ State Implementation Plan (SIP). The rule has since been repealed. This page provides information and downloadable documents on this repealed control strategy.

Description: On December 6, 2000, the TCEQ adopted a rule to restrict heavy-duty diesel construction equipment rated at 50 horsepower or more from operating from 6:00 a.m. through 12:00 p.m., April 1 through October 31, beginning April 1, 2005.

In September 2001, this rule was repealed and replaced by the Texas Emission Reduction Plan (TERP).
