SIP Revisions: Houston-Galveston-Brazoria, March 10, 2010 and December 7, 2011

Revisions to the Texas State Implementation Plan (SIP) developed for the Houston-Galveston-Brazoria (HGB) 1997 eight-hour ozone standard area.

Summary of the SIP Revisions

On October 1, 2008, the United States Environmental Protection Agency (EPA) published (73 Federal Register 56983) approval of the governor’s request to voluntarily reclassify the HGB area from a moderate to a severe nonattainment area for the 1997 National Ambient Air Quality Standard (NAAQS) for eight-hour ozone, effective October 31, 2008. The Texas Commission on Environmental Quality (TCEQ) was required to submit a 1997 eight-hour ozone SIP revision addressing the severe ozone nonattainment requirements of the Federal Clean Air Act to the EPA by April 15, 2010.

On March 10, 2010, the commission adopted two revisions to the Texas SIP for the HGB nonattainment area for the 1997 eight-hour ozone standard: the HGB Attainment Demonstration SIP Revision and the HGB Reasonable Further Progress (RFP) SIP Revision as well as associated rules. These SIP revisions were required by the EPA to demonstrate that the HGB severe nonattainment area would meet the 1997 eight-hour ozone standard by the June 15, 2019 attainment deadline.

On December 7, 2011, the commission adopted the HGB Reasonably Available Control Technology (RACT) Analysis Update SIP Revision for the 1997 Eight-Hour Ozone Standard to include Control Techniques Guidelines (CTG) documents that were not addressed in the March 2010 HGB Attainment Demonstration SIP Revision for the 1997 Eight-Hour Ozone Standard. This SIP revision also incorporated CTG-related rulemaking for the HGB area.

HGB Attainment Demonstration SIP Revision for the 1997 Eight-Hour Ozone Standard

EPA Approval: Pending. Adequacy determination of MOBILE 6.2-based Motor Vehicle Emissions Budget (MVEB) (76 FR 4342, January 25, 2011)

On March 10, 2010, the commission adopted the HGB Attainment Demonstration SIP Revision for the 1997 Eight-Hour Ozone Standard and associated rules. The attainment demonstration revision includes a photochemical-modeling analysis and a weight-of-evidence analysis to demonstrate attainment of the 1997 eight-hour ozone NAAQS by the June 15, 2019 deadline. As required by the EPA, this SIP revision also includes an MVEB, a volatile organic compounds (VOC) and nitrogen oxides (NOX) RACT analysis, a Reasonably Available Control Measures (RACM) analysis, and a contingency plan. In response to comments received, this SIP revision includes a committment to perform a 1997 eight-hour ozone mid-course review for commission consideration and approval.

The commission also adopted associated rule projects revising 30 Texas Administrative Code Chapters 101 and 115, which address cap integrity in the Mass Emissions Cap and Trade (MECT) program, a cap reduction and allowance reallocation for the Highly Reactive Volatile Organic Compounds Emissions Cap and Trade (HECT) program, and an update to control-technique guidelines for VOC used in offset printing.

HGB RACT Analysis Update SIP Revision for the 1997 Eight-Hour Ozone Standard (Project No. 2010-028-SIP-NR)

On December 7, 2011, the commission adopted the HGB RACT Analysis Update SIP Revision for the 1997 Eight-Hour Ozone Standard. Because this HGB RACT SIP revision focuses specifically on the seven CTG documents issued by the EPA from 2006 through 2008 that were not addressed in the HGB AD SIP revision adopted March 10, 2010, the RACT analysis only provides an update to the HGB VOC RACT demonstration.

This SIP revision incorporates concurrent CTG-related rulemaking that revises Chapter 115, Subchapter E to implement RACT for flexible package printing; industrial cleaning solvents; large appliance coatings; metal furniture coatings; paper, film, and foil coatings; miscellaneous industrial adhesives; and miscellaneous metal and plastic parts coatings CTG emission source categories in the HGB area.

Elements of Reasonable Further Progress Demonstration

HGB RFP SIP Revision for the 1997 Eight-Hour Ozone Standard (Project No. 2009-018-SIP-NR)

EPA Approval: Pending. Adequacy determination of MOBILE 6.2-based MVEBs (76 FR 4342, January 25, 2011)

The RFP SIP revision, as required by the EPA, demonstrates that an 18% emissions reduction requirement will be met for the analysis period of 2002 through 2008 and an average annual emissions reduction of 3% between each of the milestone years 2008, 2011, 2014, 2017, and 2018. This revision establishes baseline emission levels, calculates reduction targets, identifies control strategies to meet targets, and tracks actual emission reductions against established emissions growth. This revision also includes an MVEB for each milestone year and a contingency plan.
