Description:

These rules are part of the SIP and are intended to reduce emissions of NOx.  The rules apply to sites that are considered major stationary sources of NOx as defined in 30 TAC 117.10(29). The specific source categories that the rules apply to are listed in the applicability section of each rule. Each division applies to a specific ozone nonattainment area, as follows:

  • Division 1: BPA Ozone nonattainment area
  • Division 2: DFW ozone nonattainment area (Collin, Dallas, Denton, and Tarrant counties)
  • Division 3: HGB ozone nonattainment area
  • Division 4: DFW eight-hour ozone nonattainment area (Collin, Dallas, Denton, Ellis, Johnson, Kaufman, Parker, Rockwall and Tarrant counties)

It is important to note that, if a site is in HGB, it may be subject to the Mass Emissions Cap and Trade Program (MECT). If the site meets MECT applicability, as defined in 30 TAC 101.351, the compliance mechanism for the Chapter 117 emission specifications would be mandatory participation in MECT.
