Commissioners' Work Session #3

  1. Consideration of staff briefing on Commissioners’ priorities on rule and policy development.

    Due to time constraints the Commissioners chose not to discuss this item.

  2. Consideration of staff briefing on Senate Bill 200 (alternative fuels).

    In regards to a program staff question dealing with Commission guidance on the drafting of agency regulations affecting the State’s transit fleets and fleets in the Dallas/Fort Worth area, Commissioner Baker moved that staff take legislative intent into consideration whenever possible. The motion was seconded by Chairman McBee and passed unanimously. Legal staff stated that during the rulemaking process there may be additional issues to address/problems dealing with intent. The Commissioners requested that staff receive written notice of intent if possible and pay particular attention to any committee and floor debate that may have taken place on this issue during the most recent legislative session.

    In regards to a program staff question dealing with the agency’s fuel neutral position, Chairman McBee moved to approve the continuation of this position. The motion was seconded by Commissioner Baker and passed unanimously.

    In regards to staff questions of whether or not SB 200 and any resulting agency regulations could be interpreted as more or less stringent than federal requirements, Commissioner Marquez moved to instruct program, OPRD, and Legal staff to meet outside of the Work Session and further discuss the issue. The Commissioners will take these questions up at a future Commissioners’ Work Session. The motion was seconded by Chairman McBee and passed unanimously.

  3. Consideration of staff briefing on the reauthorization of the Safe Drinking Water Act.

    Chairman McBee moved that the Commissioners sign a letter of support and request that the Governor send a delegation to Washington, D.C. to speak in favor of Senate Bill 1316. The motion was seconded by Commissioner Marquez and passed unanimously.

  4. Consideration of staff briefing on Title V Operating Permits.

    Given the amount of activity on this issue during the next few weeks, Chairman McBee moved to continue discussion of this issue after the regular Wednesday Agenda Meeting of the Commission on December 6th and place the issue on the December 15th Commissioners’ Work Session agenda. The motion was seconded by Commissioner Marquez and passed unanimously.

  5. Planning for next work session.

    The next Commissioners’ Work Session will be held on December 15th, from 1:30 p.m. until 3:30 p.m. in room E-201S. Additional Work Sessions have also been scheduled for January 8th, January 18th, and January 26th.
