  1. Discussion of the Monthly Enforcement Report for January 2001. This issue was presented by Anne Dobbs, OCE. No action taken.


  2. Consideration to approve final TMDLs for atrazine in Aquilla Reservoir as certified updates to the State of Texas Water Quality Management Plan to satisfy federal water quality management planning requirements. This issue was presented by Chuck Mueller, SIP Section and Mel Vargas, TMDL Section. The Commission adopted the final TMDL.


  3. Consideration to approve publication to solicit public comment on the Draft Implementation Plan for fourteen TMDLs for nickel in the Houston Ship Channel. This issue was presented by Chuck Mueller, SIP Section and Mel Vargas, TMDL Section. The Commission approved publication as requested.


  4. Consideration to approve publication to solicit public comment on the Draft Implementation Plan for eleven TMDLs for legacy pollutants in streams and reservoirs in Fort Worth. This issue was presented by Chuck Mueller, SIP Section and Mel Vargas, TMDL Section. The Commission approved publication as requested.


  5. Consideration to approve publication to solicit public comment on the Draft Implementation Plan for a TMDL for dissolved oxygen in Lake Austin. This issue was presented by Chuck Mueller, SIP Section and Mel Vargas, TMDL Section. The Commission approved publication as requested.


  6. Consideration of legislative issues potentially affecting the TNRCC and actions taken by the Texas Legislature. The commission may also meet in closed meeting to receive legal advice regarding these matters, or any of the above matters, as authorized by Section 551.071 of the Open Meetings Act, Chapter 551 of the Government Code. Any commission action, decision, or vote on these matters will be made in open meeting in accordance with Section 551.102 of the Open Meetings Act, Chapter 551 of the Government Code. Glenn Shankle, DED, Machelle Pharr, CFO, Terri Seales, Excutive Cluster, Steve Minick, and Diane Mazuca, IGR discussed legislative issues. No action was taken.


  7. Planning for the next Commissioners' Work Session. The Commissioners' Work Session for April is cancelled. The next Commissioners' Work Session is tentatively scheduled for May 11. In addition to standing issues, internal audit results and Supplemental Environmental Projects percentage ratios are scheduled for discussion by staff from the Litigation Division and the preliminary annual operating budget is also tentatively scheduled for discussion by the Chief Finance Officer.


  8. Discussion and update on the implementation of the grandfathered permitting program. This issue was presented by John Steib, Dale Beebe-Farrow, and Steve Hagle of Air Permits Division presented this issue. No action was taken.

  1. Consideration of issues concerning the implementation of the state's Motor Vehicle Emissions Inspection and Maintenance (I/M) program by the Texas Natural Resource Conservation Commission and the Texas Department of Public Safety. This issue was presented by Hazel Barbour, TNRCC Technical Analysis and Major Rick Smith, DPS, Traffic Law Enforcement. The Commissions directed the General Counsels to collectively seek the State Attorney General's opinion regarding which agency has the authority to implement the I/M program. In addition, staff were directed to prepare a timeline of the issues and decisions required to be able to roll out the new I/M program May 1, 2002. A future joint work session was tentatively scheduled during the month of June 2001 to discuss the I/M program progress and legislative impacts on the I/M program.
