Enforcement Actions and Reports

Monthly and annual reports on the enforcement activities of the TCEQ, including a list of all orders and their corresponding penalties.

Monthly reports that provide the TCEQ commissioners with key status and performance indicators about agency enforcement activities.

Annual Enforcement Report

Contains key status and performance indicators about enforcement

State law requires the Texas Commission on Environmental Quality to prepare an electronic enforcement report by December 1 each year. The report is required to contain information on the enforcement actions for each type of regulatory program in the agency for the most recent fiscal year, as well as the preceding five fiscal years.

Specifically, the report contains statistical indicators and a comparative analysis for the following enforcement related activities:

  • number of investigations and complaints, by program and region
  • number of notices of violation issued, by program and region
  • number and type of enforcement actions and lists of each action, including the regulated entity name and its location, by county and region
  • amount of penalties assessed, deferred, and required to be paid to General Revenue
  • costs, offsets, and descriptions of supplemental environmental projects
  • number and percentage of enforcement orders issued to persons who previously have committed the same or similar violations
  • number and percentage of enforcement orders issued to persons that have been the subject of a previous enforcement order
  • classification of violations as major, moderate, or minor
  • most frequently cited rules and statutes in enforcement actions
  • emissions events
  • Aggregate Production Operations program
  • other information which the TCEQ deems relevant, including information on the results of enforcement actions (environmental benefit, pollutant reductions, etc.)

The monthly enforcement report provides the Commissioners with key status and performance indicators about agency enforcement activities. The report includes

  • The number of Enforcement Action Referrals received from the beginning of the fiscal year through the reporting month;
  • The number of orders issued and penalties assessed from the beginning of the fiscal year through the reporting month;
  • The number of Notices of Violations issued from Regional Offices and the TCEQ Central Office;
  • A summary of investigative activities for the current fiscal year;
  • The number of cases that are being tracked for compliance;
  • Information on the number of pending administrative orders;
  • Information on the number of backlogged cases;
  • The number of pending and finalized cases at the Attorney General's Office; and

Reports are available beginning with January 2008. The August reports contain the complete set of data for the fiscal year.

Track Pending Enforcement Actions

If a case goes to enforcement, find out the status of enforcement actions that are currently open.

Pending enforcement actions are actions that the agency will be taking in order to enforce rules, regulations, or statutes of the State. These actions are pending after they have been accepted for enforcement but the enforcement action is not effective yet. These actions can include administrative orders, court orders, compliance agreements, or referrals to other agencies or to other programs within the TCEQ, such as the Superfund program.
