TCEQ Approves Fines Totaling $1,854,902

The Texas Commission on Environmental Quality today approved penalties totaling $1,854,902 against 135 regulated entities for violations of state environmental regulations.
Agreed orders were issued for the following enforcement categories: 17 air quality, four Edwards Aquifer, three industrial or hazardous waste, four industrial waste discharge, seven multimedia, six municipal solid waste, 13 municipal waste discharge, one onsite sewage facility, 28 petroleum storage tank, 14 public water system, one utility, one wastewater operator certification, five water quality, and one water right. There was one field citation.
In addition, default orders were issued for the following categories: One air quality, two irrigation licensing, two multimedia, 10 municipal solid waste, eight petroleum storage tank, two public water system, and three water quality.
Penalties were also assessed in one petroleum storage tank case, following hearings at the State Office of Administrative Hearings.
Included in the total was a fine of $329,421 against INEOS USA LLC, Brazoria County, for a routine records review and investigation conducted Dec. 2009. Of that amount $164,710 will be contributed to a Supplemental Environmental Project to the Brazoria County Vehicle and Equipment Program.
Also included in the total was a fine of $279,125 against Pasadena Refining System, Harris County, for a routine records review and investigation conducted Sept. 2009 - June 2010.
Also included in the total was a fine of $158,450 against Shell Oil Company, Harris County, for air quality and industrial hazardous waste violations as a result of investigations conducted Feb. 2009 - April 2010. Of that amount, $79,225 will be contributed to a SEP to Friends of the River San Bernard.
