TCEQ opens public comment period on revised penalty policy proposal

Beginning today the Texas Commission on Environmental Quality is accepting comments on a proposal to revise the agency’s penalty policy that was presented to commissioners at the Aug. 25, 2011 work session.
As a result of discussions at the work session, revisions were made to tools used to calculate penalties known as matrices. They include the Environmental/Property and Human Health Matrix and the Programmatic Penalty Matrix, and a sentence was added to the end of the first paragraph after the Economic Benefit Matrix on page 17. These revisions are in addition to what was originally presented at the July 5, and Aug. 25, 2011 work sessions.
The deadline for accepting comments is Sept. 9, 2011. All comments will be summarized and presented to the commissioners at the Sept. 28, 2011 work session for their consideration.
