Manufacturer Requirements - Television Recycling Program

Compliance assistance for television manufacturers.

The following information is intended as general program guidance and should not be interpreted as a replacement of the rules. Please review the rules online at 30 Texas Administrative Code, Chapter 328, Subchapter J for complete program requirements.

Label the TVs You Sell

You may not sell new televisions—online or through a retailer—that are not labeled with your brand. The label must be permanently affixed and readily visible. This requirement was effective on May 1, 2012.

Use a Compliant Recycler

Manufacturers must document that the collection, reuse, and recycling of their collected covered television equipment complies with specific requirements . If using a TV Recycler in the state of Texas, your recycler must register with the TCEQ and follow the requirements, referenced above. Maintain a TV Recycling Program

There are two options for you to comply with this requirement:

Option 1: Individual or Group

Submit an Annual Registration and Reporting Form

The Annual Registration and Reporting Form ( ) | ( Word) must be submitted by Jan. 31 of each year and must include:

  • Manufacturer contact information
  • A list of all brands made by the manufacturer
  • $2,500 registration fee
  • Documentation that collection, reuse, and recycling meet the sound environmental management requirements
  • The total weight of TVs sold during the previous calendar year in Texas or nationally
  • The total weight of TVs from Texas collected, recycled, and reused during the previous calendar year
  • Statement of a Compliant Program
  • An Internet link containing:
    • Collection methods that allow a consumer to recycle covered television equipment without paying a separate fee at the time of recycling
    • Information for the consumer on how and where to return the television equipment labeled with the manufacturer’s brand(s)

Collect Your Market Share

In accordance with 328.185(f)(g) , we must determine the television recycling rate, by Nov. 1 of each year, and use this rate to determine the market share for each manufacturer complying individually or through a group. We will provide your market share to you by Dec. 1. You must recycle at least this amount in the following calendar year.

Option 2: Join a Recycling Leadership Program (RLP)

You must join an RLP by Jan. 1, each year, to be eligible for the RLP provisions of that year.

Submit an Annual Registration and Reporting Form

The Annual Registration and Reporting Form ( ) | ( Word) must be submitted by Jan. 31 of each year and must include:

  • Manufacturer contact information
  • A list of all brands made by the manufacturer
  • No registration fee is required if you join an RLP by Jan. 1

Submit an Annual Notification

Each RLP must submit one notification form ( ) by Jan. 31 of each year. This form includes:

  • A list of manufacturers participating as of Jan. 1
  • Documentation of a public education program with information on opportunities for collection, reuse, and recycling of TVs
  • A list of at least 200 Texas collection sites or programs planned by the RLP for the year

Submit a Biennial Report

Beginning Jan. 31, 2015, report to the TCEQ biennially, on odd years:

  • An inventory of TV-collection, reuse, and recycling opportunities available through RLP or individual manufacturers
  • Collection opportunities for populations of less than 50,000 people and analysis of collection sites compared with retail sites
  • The weight of TVs collected, recycled, and reused for the previous two years, separated by individual year
