August 9, 2007: Processing Preconstruction Permit Renewals during an Amendment Action.

Information on processing preconstruction renewals and amendments concurrently.

The PI-1 form and instructions have been updated to include an option to process a renewal application at the same time as an amendment for certain preconstruction permits under the Clean Air Act. Senate Bill 1673 [THSC 382.055 (a) (2)] (80th Leg) became effective on May 9, 2007, and has made this option possible.

According to the legislation, the amendment application must be filed not more than three years before the date that permit is scheduled to expire, and the amendment application must be subject to notice requirements under the Texas Health and Safety Code, Section 382.056. The updated instructions further specify that those pursuing this option will need to submit a Form PI-1R, Table 30R, an application fee (PDF), and a complete permit renewal application.
