December 11, 2008: New TCEQ Guidance Regarding Vacated MACT Standards

The U.S. Federal Courts have vacated several Maximum Achievable Control Technology Standards. The TCEQ is posting two memorandums to provide guidance.

The U.S. Federal Courts have vacated the Maximum Achievable Control Technology standards for
Brick and Structural Clay Products Manufacturing (40 Code of Federal Regulations (CFR) Part 63, Subpart JJJJJ; Clay Ceramics Manufacturing (40 CFR Part 63, Subpart KKKKK); and Industrial, Commercial and Institutional Boilers and Process Heaters (40 CFR Part 63, Subpart DDDDD). The TCEQ is providing guidance on the requirement to provide case-by-case MACT for major sources of hazardous air pollutants under the Federal Clean Air Act, Sections 112(g) and 112(j).
