Air PBR 106.147: Asphalt Concrete Plants

Facilities used for asphalt concrete plants that meet the conditions stated in 30 TAC Section 106.147 and were registered with the TCEQ by October 31, 2003, may operate under this permit by rule. New facilities must instead apply for a standard permit or an individual permit.

Facilities used for asphalt concrete plants that meet the conditions stated in Title 30, Texas Administrative Code (30 TAC), Section 106.147, Exit the TCEQand that were registered under this permit by rule (PBR) on or before October 31, 2003, are permitted by rule.

To operate any other asphalt concrete plant in Texas, you must first obtain the Air Quality Standard Permit for Hot Mix Asphalt Plants or an individual air permit.

If you did claim this PBR for your facility, you must continue to keep records that demonstrate that the facility satisfies the general conditions of 30 TAC Section 106.4 Exit the TCEQ and the specific conditions of this PBR. Exit the TCEQ These records must be available on request for inspection by the TCEQ or any air pollution control program that has jurisdiction.
