The Tarrant Regional Water District filed a petition with the TCEQ requesting that the TCEQ amend Title 30 of the Texas Administrative Code, Chapter 311, Subchapter G, which in part relates to water quality protection provisions for domestic wastewater discharges into the Benbrook Lake Watershed below Lake Weatherford in portions of Hood, Johnson, Parker, and Tarrant Counties.

The petition seeks to revise the definitions of the Benbrook Lake Watershed and Water Quality Area in the current rule and to add a requirement to limit total phosphorus in treated effluent to 1 milligram per liter for new or amended permits authorizing discharges greater than or equal to 1) 0.10 million gallons per day (MGD) to the Benbrook Lake Water Quality Area, and 2) 0.25 MGD to the Benbrook Lake Watershed.

After consideration of the petition for rulemaking on March 27, 2013, and in lieu of granting the petition, the TCEQ determined that additional stakeholder input is needed so that all issues related to the petition are fully explored and all potentially impacted entities have an opportunity to participate.

The TCEQ will be accepting written comments on the petition until September 9, 2013.  Comments can be sent to Mr. Gregg Easley of the TCEQ Water Quality Division at P.O. Box 13087, MC-150, Austin, Texas 78711-3087, or electronically at Gregg.Easley@tceq.texas.gov.

The original petition for rulemaking will be posted on the TCEQ web site. The Texas Administrative Code can be accessed from the Texas Secretary of State web site.
