Avinger Development Company (ADCO)

This former wood treatment facility in Avinger, Cass County is being addressed under the State Superfund Program.

Site Background

The Avinger Development Company (ADCO) site (the site) is located on the south side of State Highway 155, approximately 0.25 mile east of the intersection with State Highway 49, within the city limits of Avinger in Cass County. The 26.49-acre property is surrounded by a four foot fence. Avinger Development Company (ADCO) operated a copper, chromium, arsenate (CCA) wood treatment facility for about one year in the early 1970s. The current property owner, and site resident, purchased the land and two metal buildings in 1996. Prior to the site being proposed to the state Superfund registry, the owner built a residence inside the larger of the two metal buildings and was occupying the residence with his wife and two school-age children. Tests on the concrete slab inside the large metal building showed elevated concentrations of arsenic and chromium. A nearby abandoned discharge pit, apparently used by the family as a household drain pit, also showed elevated levels of copper, chromium and arsenic.

Superfund Actions Taken to Date

  • February, 1998, EPA tests on soil and concrete samples showed elevated concentrations of arsenic and chromium that posed a significant health risk to the residents inside the metal building.
  • September 15, 1999, a hazard ranking system (HRS) document was prepared for the Avinger Development Company (ADCO). site.
  • December 15, 1999, a legal notice was published in the Cass County Sun describing the site, proposing the site to the state Superfund registry, and announcing a public meeting to receive citizen comments would be held at the Avinger City Hall on February 3, 2000.
  • December 15, 1999, a community relations plan was prepared for the Avinger Development Company (ADCO) site.
  • December 17, 1999, a legal notice was published in the Texas Register, (24 TexReg 11590) describing the site and proposing the site for listing on the state Superfund registry. A public meeting to receive citizen comments, was scheduled at the Avinger City Hall on February 3, 2000.
  • February 3, 2000, a community meeting was held at the Avinger City Hall to explain the Superfund process and to receive any citizen comments.
  • April 20, 2000, letters requesting good-faith offers were mailed to the
    potentially responsible parties.
  • January 18, 2001, Texas Natural Resource Conservation Commission received good-faith offer responses and opened negotiations for an administrative order under Superfund.
  • May 11, 2001, the potentially responsible parties for the site notified Texas Natural Resource Conservation Commission of their intent to conduct a remedial investigation under the Voluntary Cleanup Program.
  • August 15, 2001, the Texas Natural Resource Conservation Commission Voluntary Cleanup Program completed the review of the application and assigned a project number (VCP 1370). To continue tracking this site, see the Voluntary Cleanup Program database.
  • February 14, 2002, the Voluntary Cleanup Program agreement with the Avinger
    Development Company (ADCO) was signed.
  • June 7, 2002, a legal notice Exit TCEQ Site was published in the Texas Register (27 TexReg 5015-5016) proposing to officially delete the site from the state Superfund registry in accordance with 30 TAC §335.344(b) and inviting public comment on the determination that the site has been accepted into the TNRCC Voluntary Cleanup Program. A public meeting was scheduled July 9, 2002, at the Austin headquarters of TNRCC, 12100 Park 35 Circle Austin, TX 78753 512-239-2920 (south of Yager Lane on the southbound IH-35 access road) Building D, Room 200-33.
  • July 9, 2002, a public meeting was held at the Austin headquarters of TNRCC to receive public comment on the proposed intent to delete the site from the Superfund registry in accordance with 30 TAC §335.344(b). The site has been accepted into the TNRCC Voluntary Cleanup Program. No challenges or comments were received to the determination that future cleanup will be monitored under the Voluntary Cleanup Program.
  • August 2, 2002, a legal notice Exit TCEQ Site was published in the Texas Register (27 TexReg 6897) officially deleting the Avinger Development Company (ADCO) site from the state Superfund registry in accordance with 30 TAC §335.344(c). No challenges were received on the determination that the site was eligible for deletion from the Superfund registry. The site has been accepted into the TNRCC Voluntary Cleanup Program.
  • September 1, 2002, effective date of the name change from Texas Natural Resource Conservation Commission (TNRCC) to Texas Commission on Environmental Quality (TCEQ).
  • April 29, 2005, the site was re-listed Exit TCEQ Site on the state Superfund registry because it was determined that the site was not being adequately addressed under the Voluntary Cleanup Program. Avinger Development Company (ADCO) is now categorized as a site that has been proposed to the Superfund registry.
  • November 10, 2005, a work order was issued for the continuation of the remedial investigation.
  • February 21, 2006, the groundwater classification memo was approved.
  • March 8, 2006, the field sampling plan for conducting the remedial investigation received approval.
  • April 10-14, 2006, remedial investigation field activities were ongoing, including collection and analysis of site soil, sediment and groundwater samples.
  • July 7, 2006, the first phase remedial investigation technical memorandum was approved.
  • September 7, 2006, the first phase, second tier screening level ecological risk assessment was approved.
  • January 25, 2007, the second phase remedial investigation field sampling plan addendum was approved.
  • March 19, 2007, the second phase remedial investigation field work was completed.
  • October 10, 2007, the second phase remedial investigation technical memorandum was approved.
  • July 1, 2009, a work order was issued for the continuation of the remedial investigation.
  • August 2009, a groundwater monitoring event was conducted.
  • September 23, 2009, the final Tier 2 screening level ecological risk assessment (SLERA) report was approved.
  • December 2012, The Soil Background Study was received. May 2011, the Field Sampling Plan was received.
  • December 2012, the Protective Concentration Levels Report was received.
  • December 2012, the Remedial Investigation Report, Phase III was received.
