<h3 style="background-color:transparent; border:none"><strong>Site Background</strong></h3>
<p>The Aluminum Finishing Company site is a former metal-finishing facility that   was in operation from March 1981 to January 1993. The operator was   electroplating metal nuts and bolts of various sizes by first cleaning them in a solution   of caustic sodium cyanide, and then electroplating them with cadmium and coating with   chromium. The metal-cleaning solution was neutralized with sulfuric acid.   Wastewater from the electroplating process was collected in tanks and left to   evaporate. The City of Houston had previously cited the operator for discharging   plating wastewater into the city’s sanitary sewer system. At the time of the   investigation, six rectangular tanks contained varying amounts of   cadmium/chromium sludge. The site consisted of a large metal warehouse and a   former office building at the time of the hazard ranking. Currently, the large   metal building is occupied by Riverside Kitchen and Bath and used for storage of   lumber and partially finished cabinets, and other woodworking operations. The   former office building had been converted to the current owner’s residence. </p>

<li>June 29, 2006, a public meeting to receive citizen comments was held at the   DeBakey High School for Health Professions, 3100 Shenandoah, Houston. </li>

<li>October 2, 2006, the remedial investigation/feasibility study and remedial   action is currently being negotiated with the property owner under the <a href="http://www.tceq.texas.gov/remediation/vcp/vcp.html">Voluntary   Cleanup Program</a>. </li>

<li>April 2, 2007, the property owner has begun Voluntary Clean Program activity   leading to removal of contaminated soil. </li>

<h3 style="background-color:transparent; border:none"><a name="top_of_page" id="top_of_page"></a><strong>Site Background</strong>

</h3>
<p>The American Zinc site is located near the city of Dumas, approximately 3.5   miles north on U.S. 287 and 5 miles east on Farm Road 119. The site was operated   as a zinc smelter from the late 1930s until the late 1960s or early 1970s,   generating heavy metal waste typical to that process. During World War II and   for the major part of its lifetime, the smelting plant was a source of zinc in   the United States' defense program. The abandoned smelting plant has been   decommissioned since 1957. Numerous slag piles have been deposited in, around,   and across the intermittent South Palo Duro Creek. The slag material apparently   was also used throughout the site as road base. In November 1987, the Texas   Water Commission collected samples from various locations around the site,   including the creek. Analysis showed significant contamination from lead and   cadmium.</p>





<h3 style="background-color:transparent; border:none"><strong>Superfund   Actions Taken to Date</strong></h3>
<ul type="square">

<li>October 15, 1993, a <a href="/assets/public/remediation/superfund/amerzinc/americanzinc_18texreg7201.pdf">legal notice</a> was published in the <em>Texas   Register</em> (18 TexReg 7201-7202) describing the site, proposing the site to   the state Superfund registry, and announcing that a public meeting to receive   citizen comments would be held at the city hall in Dumas on November 16, 1993. </li>

<li>July 13, 1995, effective date of an agreed order signed by the potentially   responsible parties to determine the nature and extent of contamination   (remedial investigation / feasibility study). </li>

<li>June 27, 1996, remedial investigation / feasibility study under way. </li>

<li>March 25, 1998, remedial investigation report approved by TNRCC. </li>

<li>October 5, 1998, remedial investigation addendum workplan approved. </li>

<li>May 14, 1999, TNRCC approved the remedial investigation report on additional   field work and discussed site activities. </li>

<li>June 15, 1999, an updated copy of the <a href="/assets/public/remediation/superfund/amerzinc/pdf0125.pdf">community relations plan</a> was added to   the official documents available for public viewing at the Kilgore Memorial   Library and at the TCEQ Records Management Center. </li>

<li>July 1, 1999, a legal notice was published in the <em>Moore County News   Press</em> announcing a public meeting would be held August 5, 1999, at Dumas   City Hall to present to the community a proposed nonresidential land use for the   site and to receive citizen comments. Determination of land use may impact the   remedial action proposed for the site. </li>

<li>July 2, 1999, a <a href="/assets/public/remediation/superfund/amerzinc/pdf0015.pdf">legal notice</a> was published in the <em>Texas Register</em> (24 TexReg 5068-5069) announcing a public meeting would be held August 5, 1999,   at Dumas City Hall to present to the community a proposed nonresidential land   use for the site and to receive citizen comments. Determination of land use may   impact the remedial action proposed for the site.</li>

<li>August 5, 1999, a public meeting was held at the Dumas City Hall to receive   community comments on the proposal of commercial/industrial land use   specifications for remediation of the site contamination. The nonresidential use   of the land may be considered in any remedial action proposed for the site. </li>

<li>June 9, 2000, potentially responsible party respondents met with TNRCC to   discuss additional field efforts to satisfy terms of the agreed order. </li>

<li>December 15, 2000, the consultant for the potentially responsible parties   submitted a September 12, 2000, paper to TNRCC for evaluation and comment.   Ecological and toxicological specialists in the TNRCC Technical Support section   were evaluating the acceptability of the paper's findings on allowable dietary   levels of cadmium and derivation of allowable cadmium soil concentrations for   horses and livestock. </li>

<li>July 5, 2001, TNRCC submitted comments back to the consultant for the   September 12, 2000 paper listing some concerns and ecological issues that still   needed to be addressed. </li>

<li>May 6, 2002, the TNRCC sent a letter to the consultant with additional   comments on the outstanding ecological risk assessment issues and requesting an   ecological risk assessment. </li>

<li>July 29, 2002, TNRCC received the respondent's ecological assessment work   plan. </li>

<li>September 1, 2002, effective date of the name change from Texas Natural   Resource Conservation Commission (TNRCC) to Texas Commission on Environmental   Quality (TCEQ). </li>

<li>September 26, 2002, TCEQ reviewed the respondent's ecological assessment   work, and returned it with comments. </li>

<li>October 16, 2002, TCEQ met with the respondent's consultant at the site to   note and discuss ecological receptors and additional requirements for the   ecological assessment work plan. </li>

<li>November 18, 2002, TCEQ received the revised ecological assessment work   plan. </li>

<li>March 13, 2003, TCEQ approved the February 28, 2003, addendum to the revised   site-specific ecological risk assessment work plan. The final revised   site-specific ecological risk assessment work plan is expected to be sent to   TCEQ in May for review. </li>

<li>January 12, 2004, the TCEQ approved the revised site specific ecological   risk assessment from the consultant to the potentially responsible party. </li>

<li>March 10, 2004, the TCEQ approved the remediation standards notice submitted   by the respondents. </li>

<li>February 1, 2006, the preliminary description of remedial alternatives was   received and reviewed. TCEQ comments were sent back to the consultant. </li>

<li>September 18, 2006, the description of remedial alternatives that   incorporated TCEQ comments was approved. </li>

<li>December 27, 2006, the remedial action plan was submitted by the consultant   for TCEQ review. </li>

<li>October 11, 2007, the <a href="/assets/public/remediation/superfund/amerzinc/amzinc_prad.pdf">Proposed Remedial Action Document</a> (PRAD) was finalized.</li>

<li>November 9, 2007, a <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=171926&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=171926&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=11/09/2007&amp;z_chk=">legal notice </a><a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published in the <em>Texas   Register</em> (32 TexReg 8190-8191) announcing a public meeting would be held   December 13, 2007, at Dumas City Hall to present to the community information on   a proposed remedy for the site and to receive citizen comments.</li>

<li>December 13, 2007, a public meeting was held at the Dumas City Hall to   receive community comments on the proposed remedy for the site.   
                      The proposed remedy for the source property is consolidation, capping and institutional controls. For the non-source property, the proposed remedy is institutional controls, soil treatment or other appropriate methods for addressing the affected surface soils. The <a href="/assets/public/remediation/superfund/amerzinc/american_zincsource_nonsource_map.pdf">American Zinc State Superfund Map</a> was presented at the public meeting to illustrate the affected areas on the source and non-source properties which require remediation. </li>

<li>January 31, 2008, the <a href="/assets/public/remediation/superfund/amerzinc/amzinc_final_rsd.pdf">Remedial Selection Document</a> was finalized. </li>

<li>February 27, 2008, TCEQ mailed letters to the Potentially Responsible Parties to inform them of the selected remedial action for the site and to offer the Potentially Responsible Parties the opportunity to make a Good Faith Offer to fully fund or conduct the remedial design/remedial action for the site. The letters included the Remedial Selection Document as an enclosure. </li>

<li>April 3, 2008, TCEQ mailed out letters to the Potentially Responsible Parties, inviting them to attend a meeting at TCEQ's main campus on April 17, 2008 to provide the Potentially Responsible Parties with the opportunity to discuss the site. </li>

<li>January 29, 2010, Final Administrative Order issued.</li>
<li>April 2010, Design Concept Memorandum approved. A Design Concept Memorandum   describes the remedial action in general terms, and identifies and documents   significant decision items which form the basis for the final remedial design.</li>
<li>December 2, 2010, the Post Closure Care Plan was approved.</li>
<li>March 29, 2011, the 100% Design Specifications, including the Field Sampling Plan, was approved.</li>
<li>June 2011, The Field Sampling Plan Amendment, to  include treatment of a portion of the affected off-site soil, was approved.</li>
<li>May 28, 2012, the remedial action field activities were initiated. </li>
<li>June 6, 2012, the TCEQ conducted the remedial action substantial completion inspection. </li>

<h3 style="background-color:transparent; border:none"><strong><a name="back_to_top" id="back_to_top"></a>Site Background</strong>
</h3>
<p>The Angus Road Groundwater Plume site (the site) is located beneath the 4300 block of Angus Road in Odessa, Ector County.  This site is a groundwater plume of unknown source. The plume underlies an area approximately bounded by West 47<sup>th</sup> Street on the north, Johnson Street on the west, Kermit Highway on the south, and Cessna Avenue and Brahma Road on the east. The area overlying the site consists of mixed commercial and residential properties, including a mobile home park. A variety of businesses operate in the area, including light industrial   fabrication, warehouses, storage facilities, and oil and gas production wells. The area within a half-mile radius to the south of the site consists of industrial and commercial businesses. The area to the west consists of ranch land with oil and gas production. To the east and southeast are residences with water wells, warehouses, storage facilities, welding shops, engine repair shops, supply stores, and other businesses. The area to the north is mostly residential. The TCEQ has collected groundwater samples from private and public water system wells as part of an investigation of the groundwater. These groundwater samples indicate the presence of three hazardous substances&nbsp;— 1,2-dichloroethane, 
1,2,3-trichloropropane, and manganese&nbsp;— above the health-based levels established by the United States Environmental Protection Agency. The investigation so far has not identified any potential sources for the contamination.</p>

<p>The ArChem/Thames Chelsea site (the site) is located at 13103 Conklin Lane, at the   intersection of Conklin Lane and Beltway 8, which is approximately a half mile   northwest of the intersection of State Highway 3 and Interstate Highway 45 in   southeast Houston, Harris County. The 10-acre site was formerly a specialty   chemical manufacturing facility. The site has been inactive and abandoned since   1991. Contaminants of concern at the time of the HRS include : toluene, isophorone, antimony triacetate   (S-21), bis (2 ethylhexyl) phthalate, furfural aldehyde, barium, chromium, and   1,1,2,2-tetrachloroethane. Removal actions by the TNRCC, its predecessor agency,   the Texas Water Commission and the EPA, were performed between September 1992   and August 1995, and included removing from the site: 1) all drums of   liquid/sludge and/or solid chemical wastes; 2) all surface reactor or storage   vessels containing residual chemical wastes; 3) various size process piping   containing residual chemical process wastes; and 4) all chemical waste-contaminated water and sludge from an on-site liquid separator. Completion of the remedial investigation indicated these chemicals of concern in concentrations that exceed the critical protective concentration levels in the soil at the site : antimony, lead, mercury, benzene, toluene, tetrahydroduran, 2- nitro aniline and furdural.</p>




<h3 style="background-color:transparent; border:none"><strong>Superfund   Actions Taken to Date</strong> </h3>
<ul type="square">

<li>November 17, 1992, a notice of a lien against the property was recorded in   Harris County, seeking to recover the state's portion of costs associated with   site activities to date. </li>
<li>August 15, 1993, a <a href="/assets/public/remediation/superfund/archem/pdf0136.pdf">hazard ranking system</a> document (HRS) was prepared for the   ArChem/Thames Chelsea site.</li>
<li>September 1, 1993, effective date of the creation of the Texas Natural   Resource Conservation Commission from the joining of the Texas Water Commission   and the Texas Air Control Board and a portion of the Texas Department of Health. </li>
<li>May 4, 2001, a <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=40965&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=40965&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=05/04/2001&amp;z_chk=">legal notice</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published in the <em>Houston Chronicle</em>,   and the <em>Texas Register</em>, (26 TexReg 3413) describing the site, proposing   the site for listing on the state Superfund registry, and also proposing   commercial/industrial land use specifications for remediation of the site   contamination. The non-residential use of the land may be considered in any   remedial action proposed for the site.  A   public meeting to receive citizen comments was to be held at the Dobie High   School, 11111 Beamer Road in Houston on June 12, 2001.</li>
<li>June 12, 2001, a public meeting was held at the Dobie High School to receive   community comments on the proposal of the ArChem/Thames Chelsea site for listing   on the Superfund registry and use of commercial/industrial land specifications   for remediation of site contamination. </li>
<li>December 15, 2001, a <a href="/assets/public/remediation/superfund/archem/pdf0179.pdf">community relations plan</a> was prepared for the   ArChem/Thames Chelsea site.  The complete community relations   plan is available as part of official repository records at the Bracewell Branch   Library and at the TCEQ Records Management Center. </li>
<li>April 2, 2002, the first phase of the remedial investigation field work   began at the site. Five piezometers were installed to determine the direction of   flow of groundwater. Onsite construction debris was consolidated and the site   survey was completed. A title search was also conducted. </li>
<li>August 26, 2002, the second phase of remedial investigation began. Four   monitor wells have been installed. Soil and groundwater were sampled and   analyzed. </li>
<li>September 1, 2002, effective date of the name change from Texas Natural   Resource Conservation Commission (TNRCC) to Texas Commission on Environmental   Quality (TCEQ). </li>
<li>October 2002, TCEQ received the draft report of the remedial investigation   phase 2 from the state consultant. The TCEQ project manager visited the site to   identify additional sampling locations to be included in the field sampling plan   for phase 3. </li>
<li>November 1, 2002, a work order was issued to replace the gate and repair the   fence. </li>
<li>December 15, 2002, work was completed on replacement of the front and back   gates, repair of the fence and posting of warning signs around the fence. </li>
<li>January 15, 2003, a work order was issued for completion of the writing of   the third phase of the field sampling plan. During the field events, an   electro-magnetic survey will be conducted to locate all buried metallic wastes. </li>
<li>February 15, 2003, received and approved the completed third phase field   sampling plan. </li>
<li>April 15, 2003, the third phase of the remedial investigation was completed. </li>
<li>May 15, 2003, a fifth monitor well was installed on the northeast corner of   the site. All monitor wells were sampled. </li>
<li>July 7, 2003, a work order was issued for the fourth phase of the remedial   investigation. The fourth phase included characterizing the waste at two land   farm areas, and characterizing the waste within the water and the sediment in   the impoundment. </li>
<li>August 2003, field activities for the fourth phase of the remedial   investigation were completed. An application was submitted to the TCEQ   Industrial Wastewater Permit Division for authorization to discharge the water   from two on-site impoundments. </li>
<li>September 2003, the technical memorandum on the fourth phase of the remedial   investigation was approved by TCEQ. The TCEQ water quality division has issued   effluent limitations to discharge water from two impoundments at the site. </li>
<li>December 2003, TCEQ issued a work order to begin the fifth phase of the   remedial investigation. </li>
<li>January 2004, TCEQ's contractor conducted field work at the site, which   included sampling ground water and the water and sediment in the impoundments.   Samples were also collected from the catch basin, the land farm areas inside the   metal buildings and from the northeast corner of the site. </li>
<li>March 2004, TCEQ approved the fifth phase technical memorandum that reported   the results of the investigation of the ground water and the sediment in the   impoundments. The data usability summary was also approved. </li>
<li>May 2004, TCEQ issued a work order to its contractor to summerize the five   phases of the remedial investigation and identify any data gaps. </li>
<li>June 2004, TCEQ issued a work order to sample and analyze five monitor   wells. The wells were sampled on June 16. </li>
<li>September 2004, TCEQ issued a work order to the contractor to sample the   five monitor wells in October 2004 and January 2005. </li>
<li>October 2004, the field work was completed on sampling of the five monitor   wells. </li>
<li>November 2004, TCEQ reviewed the result of the October sampling and it   showed no impact of contamination in the ground water. </li>
<li>December 2004, a work order was issued to the contractor to conduct the   feasibility study. The January 2005 monitor well sampling is still scheduled. </li>
<li>January 2005, sampling was completed on the five monitor wells at the site.   Also, a work order was issued to amend the existing field sampling plan with   additional criteria to delineate the contaminated areas at the site. </li>
<li>April 2005, the contractor conducted the field sampling to delineate the   remaining impacted areas. </li>
<li>July 2005, Remedial Investigation is completed. Chemicals of concern in concentrations that exceed the critical protective concentration levels in soil include : antimony, lead, mercury, benzene, toluene, tetrahydroduran, 2-nitroaniline and furfuryl. </li>
<li>June 9, 2006, a <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=147954&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=147954&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=06/09/2006&amp;z_chk=">legal notice</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published in the <em>Texas Register</em> (31 TexReg 4777–4778) proposing a selection of remedy for the site. TCEQ will   excavate some 5,000 cubic yards of contaminated soils, and will transport the   soil offsite for disposal. Wastewater from the surface impoundments will be   discharged after it has been determined that contaminant levels are safe.  A public   meeting to receive citizen comments is to be held Thursday, July 20, 2006, at   the new Dobie High School, 10220 Blackhawk Blvd., Houston. </li>
<li>July 20, 2006, about a dozen interested citizens attended the public meeting   to hear the presentation on the proposal to excavate about 5,000 cubic yards of   contaminated soils and transport it to an authorized disposal site. </li>
<li>October 18, 2006, letters were sent to potentially responsible parties   asking them to participate in funding the site remedy. The deadline for response   was set at January 8, 2007. </li>
<li>August 17, 2007, the PRP records search   contractor completed the review of the PRP files, printed out the information   and organized the printouts by company names. Fifteen boxes of printouts were   delivered to the TCEQ. </li>
<li>July 8, 2009, the TCEQ  Commissioners&nbsp;approved the Administrative order for the site  which&nbsp;proposed the listing of the site on the State Registry of Superfund Sites;&nbsp;  approved&nbsp; the selected remedial action&nbsp;and determined  the&nbsp;responsible parties.</li>
<li>August&nbsp;7, 2009, the TCEQ selected an  Engineer to conduct the Remedial Design for the ArChem/Thames Chelsea site.</li>
<li>August 26, 2009,  Remedial Design kick-off  meeting was conducted between the project team and the Engineer at the TCEQ  office in Austin to start the Remedial Design.</li>
<li>May 6, 2010, One hundred percent Remedial Design was completed. The TCEQ Contract Section is working on the procurement of a Remedial Action Contractor.</li>
<li>September 2, 2010, TCEQ, Engineer URS Corporation and the Contractor WRSCompas conducted Remedial Action (RA) kick-off meeting.</li>
<li>September 9, 2010, TCEQ, URS and WRSCompas conducted pre-Remedial Action site visit.</li>

<li>June 29, 2012, a legal notice was published in the June 29,  2012 issue of the <em>Texas Register</em> (<a href="http://www.sos.state.tx.us/texreg/pdf/backview/0629/0629ia.pdf">37 TexReg 4987</a>) and in the June 29,  2012 edition of the <em>Houston Chronicle</em> newspaper, proposing an intent to  take no further action and to delete the Site from the state Superfund registry  in accordance with 30 Texas Administrative Code (TAC) Section 335.344(c) and  inviting public comment on the determination that the Site no longer presents  an imminent and substantial endangerment to public health and safety or the  environment due to a release or threatened release of hazardous substances into  the environment.&nbsp; The public meeting was scheduled for August 2, 2012, 7:00pm, at  the San Jacinto College – South Campus 13735 Beamer Road, Room S-12,101  (Kaleidoscope Room) Houston, Texas.</li>

<h3 style="background-color:transparent; border:none"><strong><a name="back_to_top" id="back_to_top"></a>Site Background</strong></h3>
<p>The Avinger Development Company (ADCO) site (the site) is located on the south side of State   Highway 155, approximately 0.25 mile east of the intersection with State Highway   49, within the city limits of Avinger in Cass County. The 26.49-acre property is   surrounded by a four foot fence. Avinger Development Company (ADCO) operated a   copper, chromium, arsenate (CCA) wood treatment facility for about one   year in the early 1970s. The current property owner, and site resident,   purchased the land and two metal buildings in 1996. Prior to the site being   proposed to the state Superfund registry, the owner built a   residence inside the larger of the two metal buildings and was occupying the   residence with his wife and two school-age children. Tests on the concrete slab   inside the large metal building showed elevated concentrations of arsenic and   chromium. A nearby abandoned discharge pit, apparently used by the family as   a household drain pit, also showed elevated levels of copper, chromium and   arsenic.</p>

<h3 style="background-color:transparent; border:none"><strong>Superfund Actions Taken to Date</strong></h3>
<ul type="square">
<li>February, 1998, EPA tests on soil and concrete samples showed elevated   concentrations of arsenic and chromium that posed a significant health risk to   the residents inside the metal building. </li>

<li>September 15, 1999, a <a href="/assets/public/remediation/superfund/adco/pdf0168.pdf">hazard ranking system</a> (HRS) document was prepared for   the Avinger Development Company (ADCO). site. </li>

<li>December 15, 1999, a legal notice was published in the <em>Cass County Sun</em> describing the site, proposing the site to the state Superfund   registry, and announcing a public meeting to receive citizen comments would be   held at the Avinger City Hall on February 3, 2000. </li>

<li>December 15, 1999, a <a href="/assets/public/remediation/superfund/adco/pdf0124.pdf">community relations plan</a> was prepared for the Avinger   Development Company (ADCO) site. </li>

<li>December 17, 1999, a <a href="/assets/public/remediation/superfund/adco/pdf0099.pdf">legal notice</a> was published in the <em>Texas   Register,</em> (24 TexReg 11590) describing the site and <a href="/remediation/superfund/glossary.html#proposed facility">proposing</a> the   site for listing on the state Superfund registry.  A public   meeting to receive citizen comments, was scheduled at the Avinger City Hall on   February 3, 2000. </li>

<li>February 3, 2000, a community meeting was held at the Avinger City Hall to   explain the 
Superfund 
process and to receive any citizen comments. </li>

<li>April 20, 2000, letters requesting <a href="/remediation/superfund/glossary.html#faith">good-faith offers</a> were mailed to the<br />
potentially responsible parties. </li>

<li>January 18, 2001, Texas Natural Resource Conservation Commission received   good-faith offer responses and opened negotiations for an <a href="/remediation/superfund/glossary.html#administrative order">administrative   order</a> under Superfund. </li>

<li>May 11, 2001, the potentially responsible parties for the site notified   Texas Natural Resource Conservation Commission of their intent to conduct a   remedial investigation under the <a href="/remediation/vcp/vcp.html">Voluntary   Cleanup Program</a>. </li>

<li>August 15, 2001, the Texas Natural Resource Conservation Commission Voluntary Cleanup Program completed the   review of the application and assigned a project number (VCP 1370). <li>February 14, 2002, the Voluntary Cleanup   Program agreement with the Avinger <br />
Development Company (ADCO) was signed. </li>

<li>June 7, 2002, a <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=66053&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=66053&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=06/07/2002&amp;z_chk=">legal notice</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published in the <em>Texas Register</em> (27 TexReg 5015-5016) proposing to officially <a href="/remediation/superfund/glossary.html#deleted site">delete</a> the site   from the state Superfund registry in accordance with 30 TAC §335.344(b) and   inviting public comment on the determination that the site has been accepted   into the 
TNRCC Voluntary Cleanup   Program. A public   meeting was scheduled July 9, 2002, at the Austin headquarters of TNRCC, 12100   Park 35 Circle Austin, TX 78753 512-239-2920 (south of Yager Lane on the   southbound IH-35 access road) Building D, Room 200-33. </li>

<li>July 9, 2002, a public meeting was held at the Austin headquarters of TNRCC   to receive public comment on the proposed intent to delete the site from the   Superfund registry in accordance with 30 TAC §335.344(b). The site has been   accepted into the TNRCC Voluntary Cleanup   Program. No challenges or comments were received to the determination that   future cleanup will be monitored under the Voluntary Cleanup Program. </li>

<li>August 2, 2002, a <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=68842&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=68842&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=08/02/2002&amp;z_chk=">legal notice</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published in the <em>Texas Register</em> (27 TexReg 6897) officially <a href="/remediation/superfund/glossary.html#deleted site">deleting</a> the   Avinger Development Company (ADCO) site from the state Superfund registry in   accordance with 30 TAC §335.344(c). No challenges were received on the   determination that the site was eligible for deletion from the Superfund   registry. The site has been accepted into the TNRCC Voluntary Cleanup Program.</li>

<li>September 1, 2002, effective date of the name change from Texas Natural   Resource Conservation Commission (TNRCC) to Texas Commission on Environmental   Quality (TCEQ). </li>

<li>April 29, 2005, the site was <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=127967&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=127967&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=04/29/2005&amp;z_chk=">re-listed</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> on the state Superfund registry   because it was determined that the site was not being adequately addressed under   the Voluntary Cleanup Program. Avinger Development Company (ADCO) is now categorized as a   site that has been proposed to the Superfund registry. </li>

<li>November 10, 2005, a work order was issued for the continuation of the   remedial investigation. </li>

<li>February 21, 2006, the groundwater classification memo was approved. </li>

<li>March 8, 2006, the field sampling plan for conducting the remedial   investigation received approval. </li>

<li>April 10-14, 2006, remedial investigation field activities were ongoing, including collection and analysis of site soil, sediment and groundwater   samples. </li>

<li>July 7, 2006, the first phase remedial investigation technical memorandum   was approved. </li>

<li>September 7, 2006, the first phase, second tier screening level ecological   risk assessment was approved. </li>

<li>January 25, 2007, the second phase remedial investigation field sampling   plan addendum was approved. </li>

<li>March 19, 2007, the second phase remedial   investigation field work was completed. </li>

<li>October 10, 2007, the second phase remedial  investigation technical memorandum was approved.</li>
<li>July 1, 2009, a work order was issued for the  continuation of the remedial investigation.</li>

<h3 style="background-color:transparent; border:none"><strong><a name="top_of_page" id="top_of_page"></a>Site Background</strong>

<p>The Aztec Ceramics Corporation site is located at 4735 Emil Road in San Antonio, Bexar county, Texas. The   facility was used for the manufacture of ceramic tile products for about 50   years. Operations ceased in 1988. At the time of proposal to the state Superfund   registry, there were three surface impoundments on the north side of the   property. Drums of waste oil had been spilled in various locations throughout   the warehouse. Also, there were drums of waste glaze materials deteriorating in   the warehouse.</p>




<h3 style="background-color:transparent; border:none"><strong>Superfund   Actions Taken to Date</strong></h3>
<ul type="square">

<li>April 11, 1995, a <a href="/assets/public/remediation/superfund/aztec_ceramics/aztecceramics_20texreg2733.pdf">legal notice</a> was published in the <em>Texas Register</em>, (20 TexReg 2733) describing the site, and proposing the site for listing on the   state Superfund registry.  A   public meeting to receive citizen comments was to be held at the Carver Branch   Library on May 16, 1995. </li>

<li>May 16, 1995, a public meeting was held at the Carver Branch Library to   receive community comments on the proposal to list the Aztec Ceramics Corporation site on   the Superfund registry. </li>

<li>July 20, 1996, TNRCC issued a work order to determine the nature and extent   of contamination (remedial investigation). </li>

<li>January/February 1999, all buildings were demolished and the debris was   removed from the site. The work was done by the property owner under an   agreement with the Texas attorney general. </li>

<li>February 1998, TNRCC removed approximately 200 drums of waste from the site. </li>

<li>February 22, 1999, Phase II of the remedial investigation field work, to   better define the volume of contaminated soils and glaze waste, was under way. </li>

<li>June 2, 1999, the Phase II report was approved by the TNRCC, marking the end   of the remedial investigation phase. </li>

<li>July 16, 1999, a <a href="/assets/public/remediation/superfund/aztec_ceramics/pdf0016.pdf">legal notice</a> was published in the <em>Texas Register,</em> (24 TexReg 5593) and the <em>San Antonio Express-News,</em> to propose   non-residential land use specifications for remediation of the site   contamination. The land use designation may 
be considered in any remedial action   proposed for the site. A   public meeting was to be held August 17, 1999, at the Barbara Jordan Center on   East Commerce Street </li>

<li>August 17, 1999, a public meeting was held at the Barbara Jordan Center to   receive community comments on the proposal to use non-residential land use   specifications for remediation of the site contamination. The land use   designation may be considered in any remedial action proposed for the site. </li>

<li>September 3, 1999, a <a href="/assets/public/remediation/superfund/aztec_ceramics/pdf0093.pdf">legal notice</a> was published in the <em>Texas   Register,</em> (24 TexReg 7056-7057) and the <em>San Antonio Express-News,</em> to present to the community the cleanup alternatives and to receive citizen   comments to be considered in the final recommended remedy, which was   consolidation and containment with capping.  A   public meeting was to be held October 7, 1999, at the Pfeiffer Elementary School   in San Antonio. </li>

Antonio to receive comments on the proposed cleanup alternative, which was   consolidation and containment with capping. </li>

<li>June 6, 2000, TNRCC issued a final administrative order, directing the   potentially responsible party to develop a remedial design and perform the   remedial action. The order set cleanup levels, selected the remedy for cleanup,   and established rules, responsibilities and enforcement options for remedial   design/remedial action under state Superfund process. Included with the order   was a directive to maintain and monitor the site after the cleanup work was   completed. </li>

<li>June 16, 2000, effective date of a final TNRCC administrative order, setting   cleanup levels, selecting the remedy for the cleanup, and establishing rules,   responsibilities and enforcement options for the remedial design/remedial action   under the state Superfund process. By issuing the order, the TNRCC has   determined that the facility poses an imminent and substantial endangerment to   public health and safety or the environment and has listed the site on the state   Superfund registry. </li>

<li>July 17, 2000, no responsible party submitted a good faith offer to perform   or fund the remedy by the deadline specified in the administrative order. </li>

<li>August 23, 2000, an affidavit of lien payable to the commission was filed in   the Bexar County real property records by the TNRCC. The lien was filed pursuant   to the Texas Solid Waste Disposal Act, Texas Health and Safety Code §361.194, to   recover the state's remediation expenses. </li>

<li>October 17, 2000, a work order was issued to prepare the remedial design for   the cleanup. The remedial design is the engineering phase. It includes   engineering drawings and specifications for construction of the remedy. The   remedial action will implement the design. </li>

<li>February 2002, TNRCC and the contractor finalized the remedial design for   the asphalt cap remedy for the site. </li>

<li>July 9, 2002, TNRCC issued a work order to the contractor for implementation   of the final remedy. </li>

<li>July 25, 2002, an updated copy of the <a href="/assets/public/remediation/superfund/aztec_ceramics/pdf0205.pdf">community relations plan</a> was prepared   for the Aztec Ceramics Corporation site.  The complete community relations   plan is available as part of official repository records at the Carver Public   Library in San Antonio and at the TCEQ Records Management Center. </li>

<li>August 23, 2002, the project manager approved the asphalt cap completing the   remedy. </li>

<li>August 28, 2002, The project manager approved the final closeout report for   the completion of the remedial action of the asphalt cap. An operation and   maintenance plan was initiated to begin annual groundwater monitoring and   maintenance inspections of the cap and the surrounding fence which protects   against any vehicular traffic across the cap. </li>

<li>September 1, 2002, effective date of the name change from Texas Natural   Resource Conservation Commission (TNRCC) to Texas Commission on Environmental   Quality (TCEQ). </li>

Ground water will continue to be   monitored on an annual basis, and maintenance inspections will be performed on   the cap and the perimeter fence. A   public meeting was scheduled June 17, 2003, at the Pfeiffer Elementary School. </li>

<li>June 17, 2003, a public meeting was held at Pfeiffer Elementary School to   receive community comments on the proposal to delete the site from the state   Superfund registry. A summary of the <a href="/assets/public/remediation/superfund/aztec_ceramics/pdf0248.pdf">comments made and the TCEQ's response</a> to   those comments was prepared in the responsiveness summary. The responsiveness   summary was mailed to the meeting attendees and also made available at the   repositories.</li>

<li>September 2003, during the month, the site was referred to the office of the   Texas attorney general for cost recovery action. The attorney general filed a   notice of claim against the responsible parties. </li>

<li>November 21, 2003, a <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=101496&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=101496&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=11/21/2003&amp;z_chk=">legal notice</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published in the <em>Texas   Register</em> (28 TexReg 10553-10554), officially <a href="/remediation/superfund/glossary.html#deleted site">deleting</a> the Aztec Ceramics Corporation site from the state Superfund registry in accordance with 30 TAC   §335.344(c). It was determined that the site no longer presented an imminent and   substantial endangerment to public health and safety or the environment. Ground   water will continue to be monitored on an annual basis, and maintenance   inspections will be performed on the cap and the perimeter fence.  A deed notice has been filed in the real property records of   Bexar County which restricts use of the property to commercial - industrial   (non-residential). </li>

<li>April 2005, a work order was issued to perform the annual operations and   maintenance work at the site. The work consists of annual groundwater monitoring   and inspection of the asphalt cap. </li>

<li>May 2005, annual operation and maintenance was performed at the site by the   TCEQ contractor. Sampling results continue to demonstrate that the cap that   covers the on-site waste vault is performing properly and the groundwater is not   impacted by contaminants of concern. </li>

<li>April 2006, annual operation and maintenance was performed at the site by   the TCEQ contractor. Sampling results continue to demonstrate that the cap that   covers the on-site waste vault is performing properly and the groundwater is not   impacted by contaminants of concern. </li>

<li>March 30, 2007, a work order was prepared to perform the annual operations   and maintenance work at the site during the month of April. The work consists of   annual groundwater monitoring and inspection of the asphalt cap. </li>

<li>August 22, 2007, the TCEQ approved the report   of annual operations and maintenance activities conducted in April, 2007 </li>
<li>June 6, 2011, a TCEQ contractor began work to remove vegetation.</li>
<li>July 2011, the TCEQ conducted a sampling event on  six&nbsp;monitoring wells&nbsp;and repairs were made to the asphalt cap and  fence.</li>
<li>December 15, 2011, the results of the July 2011 sampling show Arsenic, Barium, Cadmium, Chromium, Copper, Nickel, Lead, Selenium, and Zinc are all below the level of required performance (LORP) for groundwater.</li>
<li>July 2012, Mowing event occurred.</li>
<li><a id="latest" name="latest"></a>August 2012, Herbicide was applied to the site to control vegetation growth.</li>

<p>The Aztec Mercury site is located at 970 Callaway Drive,at the corner of   Callaway Drive and West Dumble Street in Alvin, Brazoria county, Texas. From 1974 to 1985, mercury was   recycled at this site. An enforcement order issued by the Texas Water Commission   on May 13, 1986, required operations to cease.</p>




<h3 style="background-color:transparent; border:none"><strong>Superfund   Actions Taken to Date</strong></h3>

<li>October 16, 1987, a <a href="/assets/public/remediation/superfund/aztec_mercury/aztecmercury_12texreg3858.pdf">legal notice</a> was published in the <em>Texas   Register</em> (12 TexReg 3858-3859) <a href="/remediation/superfund/glossary.html#proposed%20facility">proposing</a> the site to the state Superfund registry and announcing that a public meeting to   receive citizen comments would be held at the Pasadena Convention Center on   November 4, 1987. </li>

<li>September 1, 1993, effective date of the creation of the Texas Natural   Resource Conservation Commission from the joining of the Texas Water Commission   and the Texas Air Control Board and a portion of the Texas Department of Health. </li>

<li>January 22, 1988, a <a href="/assets/public/remediation/superfund/aztec_mercury/aztecmercury_13texreg427.pdf">legal notice</a> was published in the <em>Texas   Register</em> (13 TexReg 427-428) <a href="/remediation/superfund/glossary.html#listed facility">listing</a> the site   on the state Superfund registry. </li>

<li>April 13, 1990, remedial investigation/feasibility study under way.</li>

<li>July 8, 1994, TNRCC approved the remedial investigation report as submitted. </li>

<li>July 14, 1994, the soil, sediment unit was separated from the groundwater   unit so that focused cleanup remedies could proceed more rapidly. The result of   the separation was completion of the remedial investigation/feasibility study   phase for the soil, sediment unit. </li>

<li>August 30, 1994, TNRCC accepted and approved the final baseline risk   assessment report. </li>

<li>August 31, 1994, TNRCC accepted the final feasibility study report that   evaluated several remedial options for cleaning up the soils and sediment. Based   on the feasibility study, the recommended remedial option was excavation and   offsite disposal of contaminants. </li>

<li>October 17, 1994, a legal notice was published in the <em>Alvin   Sun-Advertiser</em> announcing 
a public meeting would be held December 8, 1994,   at Alvin Junior High School to present to the community the best choice among   cleanup remedies and to receive citizen comments on the final recommended   remedy. </li>

<li>October 18, 1994, a <a href="/assets/public/remediation/superfund/aztec_mercury/aztecmercury_19texreg8313.pdf">legal notice</a> was published in the <em>Texas   Register</em> (19 TexReg 8313) announcing a public meeting would be held   December 8, 1994, at Alvin Junior High School to present to the community the   best choice among cleanup remedies and to receive citizen comments on the final   recommended remedy. </li>

<li>December 8, 1994, a public meeting was held at Alvin Junior High School to   receive comments on the proposed cleanup alternative for the soil unit, which   was excavation and off-site disposal. The completion of the remedial   investigation/feasibility study for the groundwater unit is pending completion   of removal of the soil. </li>

<li>September 29, 1995, TNRCC issued a unilateral administrative order directing   the potentially responsible party to perform the remedial design and remedial   action at the site. The unilateral administrative order was effective   immediately. </li>

<li>September 1997, remedial action for the soil, sediment unit underway. </li>

<li>March 3, 1998, an affidavit of lien payable to the commission was filed in   the Brazoria County real property records by the TNRCC. The lien was filed   pursuant to 
the Texas Solid Waste Disposal Act, Texas Health and Safety Code   §361.194, to 
recover the state's remediation expenses. </li>

<li>March 13, 1998, TNRCC approved the final remedial action report. <a href="#April9">See addendum: April 9, 2002</a> </li>

<li>July 3, 1998, a <a href="/assets/public/remediation/superfund/aztec_mercury/pdf0065.pdf">legal notice</a> was published in the <em>Texas Register</em> (23 TexReg 7135-7136) proposing to <a href="/remediation/superfund/glossary.html#deleted 20site">delete</a> the site   from the state Superfund registry in accordance with 30 TAC §335.344(c) and   inviting public comment on the determination that the site no longer presents an   imminent and substantial threat to public health and safety or the environment.   No further remedial action planned.</li>

<li>July 6, 1998, a legal notice was published in the <em>Alvin Sun,</em> proposing to delete the site from the state Superfund registry in accordance   with 30 TAC §335.344(c), and inviting public comment on the determination that   the site no longer presents an imminent and substantial endangerment to public   health and safety or the environment. No further remedial action planned. </li>

<li>August 28, 1998,  a <a href="/assets/public/remediation/superfund/aztec_mercury/pdf0070.pdf">legal notice</a> was published   in the <em>Texas Register</em> (23 TexReg 8915), officially <a href="/remediation/superfund/glossary.html#deleted 20site">deleting</a> Aztec   Mercury from the state Superfund registry in accordance with 30 TAC §335.344(c).   No challenges or comments were received on the determination that the site no   longer presents an imminent and substantial endangerment to public health and   safety or the environment. No further remedial action planned. </li>

<li>April 9, 2002: Addendum to March 13, 1998,   information. The report confirmed that as a result of the removal action of soil   and sediment, there was no longer a source for groundwater contamination, and   the site no longer presented an endangerment to public health or the environment   and is suitable for residential use. </li>

<p>The Bailey Metal Processors, Inc., site is located approximately one mile   northwest of Brady, McCulloch county, Texas, on Highway 87. The site occupies five   acres. The triangular-shaped site is bordered to the south by a railroad, to the north   by the Brady Independent School District bus barn and two mobile homes, and to   the east by Highway 87. The facility operated as a scrap metal dealer, primarily   conducting copper and lead reclamation. Paper, plastic, and lead coatings were   removed from wires to reclaim the metals. Two furnaces at the site were used to   burn off the plastic insulation from the wire.</p>
<h3 style="background-color:transparent; border:none"><strong>Superfund Actions Taken to Date</strong></h3>
<ul type="square">

<li>August 2004, a <a href="/assets/public/remediation/superfund/bailey/pdf0306.pdf">hazard ranking system</a> (HRS) document was prepared for the   Bailey Metal Processors, Inc., site.   The complete hazard ranking system   document is available as part of official repository records at the Richards   Memorial Library and the TCEQ Records Management Center.</li>

<li>February 2005, a <a href="/assets/public/remediation/superfund/bailey/pdf0307.pdf">community relations plan</a> was prepared for the Bailey Metal   Processors, Inc., site. </li>

<li>March 24, 2005, TCEQ began mailing out requests to identified potentially   responsible parties, asking them to participate in an agreed order to fund or   perform a remedial investigation and feasibility study at the site. </li>

<li>March 28, 2005, a legal notice was published in the <em>Brady Herald   Standard</em> describing 
the site, proposing the site to the state Superfund   registry, and announcing that a public meeting to receive citizen comments would   be held May 12, 2005, at the Brady City Hall. </li>

<li>April 1, 2005, a <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=127247&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=127247&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=04/01/2005&amp;z_chk=">legal notice</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published in the <em>Texas Register</em> (27 TexReg 6575) describing the site, <a href="/remediation/superfund/glossary.html#proposed facility">proposing</a> the   site for listing on the state Superfund registry, proposing   commercial/industrial land use designation for the site, and announcing that a   public meeting to receive citizen comments would be held May 12, 2005, at the   Brady City Hall council chambers. </li>

<li>May 12, 2005, a public meeting was held at the Brady City Hall council   chambers to receive citizen comments on the proposal to list the Bailey Metal   Processors site on the state Superfund registry. There were no challenges to the   use of nonresidential standards in the planned remedial action proposed for the   site. </li>

<li>May 2006, a work order was issued for the start of the remedial   investigation. Also, soil samples were collected onsite and from surrounding   properties. </li>

<li>June 2006, a work order was issued for the start of the groundwater   investigation and additional sampling of off-site soils. </li>

<li>September 2006, a groundwater and off-site soil investigation sampling event   was performed. </li>

<li>December 2006, the results of the September   2006 groundwater and off-site soil investigation sampling event were received. </li>

<li>December  2008 a groundwater sampling event was conducted.</li>

<li>March 16, 2009, a groundwater sampling event was conducted.</li>
<li>June 4, 2009, a groundwater sampling event was conducted.</li>
<li>May 2011, a groundwater monitoring event occurred at the site.</li>

  <li>    July 2011, four new monitor wells were installed on-site, and a groundwater monitoring event occurred at the site.</li>
  <li>    August 2011, the Remedial Investigation continued with Phase 5 of the investigation. Phase 5 included: 
    <ul>
      <li> a well yield test on four on-site monitor wells to determine the groundwater classification below the site; </li>
      <li>        collection of 30 soil samples on and off-site at depths of 0 to 0.5 feet (ft) below ground surface (bgs), 3 to 3.5 ft bgs, 6 to 6.5 ft bgs, and 9 to 9.5 ft bgs in order to determine the vertical extent of contamination;</li>
      <li> collection of three geotechnical samples to determine soil pH, particle size distribution, and fraction organic carbon; and </li>
      <li> a survey conducted by Bury+Partners, Inc. on the waste piles throughout the site in order to determine the volume of waste on-site.</li>
    </ul>
  </li>
  <li>February 2012, a groundwater monitoring event occurred at the site.</li>
  <li>    June 2012, the Remedial Investigation continued with Phase 6 of the investigation. Phase 6 included:
    <ul>
      <li> instillation of 22 direct push technology (DPT) boreholes to depths of 25 ft bgs, on and off-site, in order to delineate the gravely material below the site;</li>
      <li> collection of groundwater grab samples from the DPT boreholes;</li>
      <li> instillation of seven temporary monitor wells in order to collect additional groundwater data;</li>
      <li> collection of four sediment samples from areas around the Bailey Metal Processors, Inc. Site to determine if a release had occurred to nearby soils; </li>
      <li> a Screening Level Ecological Risk Assessment (SLERA) Report; and </li>
      <li> a slug test on all seven on-site monitor wells to collect additional groundwater data.</li>
    </ul>
  </li>
  <li><a id="latest" name="latest"></a>    July 2012, a groundwater monitoring event occurred at the site to monitor the concentrations of arsenic and antimony.</li>

<h3 style="background-color:transparent; border:none"><strong><a name="top_of_page" id="top_of_page"></a>Site Background</strong>
</h3>
<p>The Baldwin Waste Oil site (the site) is located on County  Road 44, approximately 0.1 mile west of its intersection with FM 1889, in  Robstown, Nueces County, Texas. The property was leased for use as a waste oil  processing facility. The site was inspected by the Texas Water Commission in  November 1986, and found to be abandoned. The site currently consists of a  benzene groundwater plume that is being monitored for natural attenuation. </p>



<h3 style="background-color:transparent; border:none"><strong>Superfund   Actions Taken to Date</strong></h3>
<ul type="square">

<li>October 16, 1987, a <a href="/assets/public/remediation/superfund/bald/baldwin_12texreg3858.pdf">legal notice</a> was published in the <em>Texas   Register</em> (12 TexReg 3858-3859) <a href="/remediation/superfund/glossary.html#proposed facility">proposing</a> the   site to the state Superfund registry and announcing that a public meeting to   receive citizen comments would be held at the Nueces County Memorial   Agricultural Center in Robstown on November 12, 1987. </li>

<li>November 1987-July 1992, attempts were made to negotiate funding for the   remedial investigation and for removal of contaminated materials from the site. </li>

<li>January 22, 1988, a <a href="/assets/public/remediation/superfund/bald/baldwin_13texreg427.pdf">legal notice</a> was published in the <em>Texas   Register</em> (13 TexReg 427-428) <a href="/remediation/superfund/glossary.html#listed facility">listing</a> the site   on the state Superfund registry. </li>

<li>In July 1992, the EPA conducted a removal action. Waste from the tanks and   sludge was removed to an off-site incineration facility. The tanks were cut up   and removed off site as scrap metal and a pilot-scale bioremediation cell was   constructed in the former tank farm area. </li>

<li>September 1, 1993, effective date of the creation of the Texas Natural   Resource Conservation Commission from the joining of the Texas Water Commission   and the <br />
Texas Air Control Board and a portion of the Texas Department of Health. </li>

<li>June 1, 1995, remedial investigation/feasibility study under way. </li>

<li>March 3, 1999, TNRCC completed baseline risk evaluation report. </li>

<li>March 22, 1999, remedial investigation completed and approved by TNRCC. </li>

<li>April 20, 1999, a groundwater presumptive remedy document was completed. </li>

<li>April 23, 1999, a <a href="/assets/public/remediation/superfund/bald/pdf0079.pdf">legal notice</a> was published in the <em>Texas Register</em> (24 TexReg 3245-
3246) announcing a public meeting would be held May 25, 1999, at   the Nueces County Auditorium in Robstown to present to the community the best   choice among cleanup remedies and to receive citizen comments to be considered   in the final recommended remedy. </li>

<li>May 25, 1999, a public meeting was held at the Nueces County Auditorium in   Robstown to receive comments on the cleanup remedy proposal to monitor the   groundwater twice yearly for three years and then once yearly to see if natural   attenuation was taking place. </li>

<li>June 8, 1999, good-faith offer request letters were sent to potentially   responsible parties which asked them to respond with an offer to fund the   groundwater monitoring. Responses were due by August 16, 1999. </li>

<li>June 29, 1999, TNRCC responded to citizen comments from the May 25, 1999,   public meeting. </li>

<li>February 29, 2000, TNRCC issued an administrative order  setting out the   final responsibilities of the potentially responsible party to finish the   cleanup. The order set cleanup levels, selected the remedy for cleanup, and   established rules, responsibilities and enforcement options for remedial   design/remedial action under state Superfund process. TNRCC would be responsible   for groundwater monitoring after the cleanup was complete. </li>

<li>March 10, 2000, effective date of a TNRCC <a href="/assets/public/remediation/superfund/bald/baldwin_ao.pdf">administrative order</a>. As of the   order date, the soil remediation was complete. In the operation and maintenance   phase, the groundwater was to be monitored by TNRCC for the effectiveness of   natural attenuation. </li>

<li>July 3, 2000, the operation and maintenance sampling and analysis plan was   approved. </li>

<li>July 5, 2000, the operation and maintenance quality assurance project plan   was approved. </li>

<li>July 13, 2000, monitoring was under way with the first round of groundwater   sampling. </li>

<li>August 29, 2000, a report was received on results of the first year of   natural attenuation of the groundwater to ensure that the concentration of   contaminants was being reduced through natural processes. </li>

<li>July 17, 2001, groundwater was sampled at the monitor wells to track the   natural attenuation of contaminants. </li>

<li>December 20, 2001, groundwater was sampled at the monitor wells to track the   natural attenuation of contaminants. </li>

<li>April 15, 2002, the report was received on results of the second year of   natural attenuation of the groundwater to ensure that the concentration of   contaminants was being reduced through natural processes. </li>

<li>July 30, 2002, groundwater was sampled at the monitor wells to track the   natural attenuation of contaminants. </li>

<li>September 1, 2002, effective date of the name change from Texas Natural   Resource Conservation Commission (TNRCC) to Texas Commission on Environmental   Quality (TCEQ). </li>

<li>January 9-10, 2003, groundwater was sampled at the monitor wells to track   the natural attenuation of contaminants. In addition, an oxygen-releasing   compound was added to monitor well 9 to attempt to increase the rate of natural   attenuation by increasing the amount of oxygen available in the groundwater. </li>

<li>May 29, 2003, semiannual sampling of groundwater was completed. </li>

<li>August 19, 2003, TCEQ approved the annual report for the operation and   maintenance sampling results. </li>

<li>January 30, 2004, groundwater was sampled at the monitor wells to track the   natural attenuation of contaminants. </li>

<li>March 2004, TCEQ finished the review and accepted the data usability study   of the samples taken in January. Also, TCEQ reviewed and accepted the annual   groundwater monitoring report for operations and maintenance at the site. </li>

<li>May 19, 2004, an updated <a href="/assets/public/remediation/superfund/bald/pdf0289.pdf">community relations plan</a> was prepared for the   Baldwin Waste Oil site.</li>

<li>January 10-11, 2005, the annual groundwater sampling event and site   maintenance was performed. </li>

<li>March 2005, TCEQ reviewed and accepted the annual operations and maintenance   groundwater monitoring report. </li>

<li>October 25, 2005, the Texas Office of Attorney General entered into an   agreed judgment on behalf of the TCEQ with SGS Control Services, Inc., Saybolt,   Inc., and Caleb Brett USA, Inc. According to the agreed judgment, SGS Control   Services, Inc., Saybolt, Inc., and Caleb Brett USA, Inc. paid the state $60,000   total. The agreed judgment resolves the alleged civil liability of SGS Control   Services, Inc., Saybolt, Inc., and Caleb Brett USA, Inc., for cleanup,   remediation and response costs associated with the site and contains no   admission of liability. </li>

<li>January 2006, negotiations for settlement are ongoing with the Brownsville   Navigation District. </li>

<li>June 30, 2006, a <a href="/assets/public/remediation/superfund/bald/pdf0358.pdf">legal notice</a> was published in the <em>Texas Register</em> (31 TexReg 5378–5379) by the Office of Attorney General giving notice of a   proposed agreed final judgment by the Brownsville Navigation District of Cameron   County for its share of costs of remediation of the site and agreement to take   over remedial activities at the site.</li>

<li>August 1, 2006, The Texas Office of the Attorney General entered into an   agreed judgment on behalf of the TCEQ with the Brownsville Navigation District.   According to the agreed judgment, the Brownsville Navigation District will pay   the state $350,000 total over three years and will take over operation and   maintenance of the site. The agreed judgment resolves the Brownsville Navigation   District's alleged civil liability for response costs associated with the site   and contains no admission of liability. </li>

<li>November 29, 2006, the Baldwin Waste Oil consultant submitted the results of   the first semi-annual groundwater monitoring event. Additional groundwater   monitoring is required. </li>

<li>January 30, 2008, the Baldwin Waste Oil  consultant submitted a summary   groundwater monitoring report indicating that groundwater monitoring needs to   continue. The next sampling event will be due in the fall of 2008. </li>

<li>September 9, 2008: Monitored natural attenuation of the groundwater is ongoing.  Semi-annual sampling indicates that despite some fluctuation benzene levels in the plume are decreasing, particularly in response to the addition of oxygen-releasing compounds.  The plume is stable and decreasing in size.</li>
<li>April 30, 2009, Monitored natural attenuation of the  groundwater is ongoing. Semi-annual sampling indicates benzene levels in the  plume are decreasing, particularly in response to the addition of  oxygen-releasing compounds. The plume is stable and decreasing in size.</li>
<li>October  27, 2009,&nbsp;the second semi-annual groundwater monitoring event was  conducted. Previous sampling events indicate benzene levels in the plume are  decreasing, particularly in response to the addition of oxygen-releasing  compounds. Monitored natural attenuation of the groundwater is ongoing.The  plume is stable and decreasing in size</li>
<li>May   25, 2011, TCEQ received 2010 Annual Groundwater Monitoring Report (AGMR). </li>
<li>June 13, 2011, TCEQ approved the 2010 AGMR. Monitored  natural attenuation of the groundwater is ongoing. The 2010 Annual Groundwater  Sampling Report indicates benzene levels in the plume are still above the protective  concentration level of 5 parts per billion (ppb). The groundwater contaminant  plume appears stable and the annual groundwater monitoring will continue.</li>
<li>A<a id="latest" name="latest"></a>pril 13, 2013, the TCEQ sent a letter to the Brownsville Navigation District regarding their AGMRs.</li>

  <li><strong>April 2013</strong>, a Remedial Investigation Technical Memorandum was completed that summarized the results of the routine groundwater monitoring event and the arsenic background study as follows:<br />

  <p><strong>Groundwater monitoring</strong> - The groundwater analytical results were consistent with previous results for elevated arsenic levels (levels greater than 0.01 mg/L) in a majority of the wells.  Elevated arsenic levels were detected in the second groundwater bearing unit at two of the new monitoring well locations.  One monitoring well located in the west pit was found to have light non-aqueous phase liquid (LNAPL) in the well and was not sampled.</p>
  <p> <strong>Arsenic background study</strong> - An arsenic concentration of 0.0396 mg/L was determined to represent the upper 95% statistical limit of background arsenic in off-site drinking water wells.  An arsenic concentration of 0.119 mg/L was determined to represent the upper 95% statistical limit of background arsenic in surface water.</p>

  <li><strong>March 2013</strong>, a scoping meeting in Austin was held to determine requirements for completing an Affected Property Assessment Report (as part of the Remedial Investigation) and initiation of a Feasibility Study.</li>

  <li> <strong>December 2012</strong>, three new monitoring wells were installed and screened in the second groundwater bearing unit adjacent to each of the pits, and routine groundwater monitoring of the existing monitoring wells at the site was completed.  Water samples from off-site drinking water wells and off-site surface water samples were collected for an arsenic background study.<br />

  <li><strong>September 20, 2012</strong>, Development of a Remedial Investigation work plan (RIWP) is in progress to determine vertical extent of contaminants.  The work plan will support installation of three double cased monitoring wells to be completed one each in the second groundwater bearing unit beneath the east, west and north pits.  The RIWP will also address routine groundwater monitoring of existing on-site and off-site monitoring wells, and a study of background groundwater arsenic levels.  The field work is planned for early October 2012. </li>
</ul>

  <li><strong>July 2012</strong>, The Final Historical Chain of Title and Plat Map, and Superfund Sites B Current Property Owner Report was completed  to support the effort to file a lien on the property.</li>
</ul>
<h3 style="background-color:transparent; border:none">Site Background</h3>
<p>The Ballard Pits site is a former sand and gravel pit that was used in the late 1960s for storage and disposal of waste material. The site is located at the end of Ballard Lane, west of its intersection with County Road 73 approximately 5.8 miles north of Robstown in Nueces County. Historically the Ballard Sand and Gravel Company operated on the property.&nbsp; The Brine Services Company (Brine Services) used the Ballard property for storage of oilfield drilling mud and disposal of refinery waste in the late 1960s.&nbsp; In 1968 the Texas Water Quality Board issued an order requiring Brine Services to cease all waste disposal at the property.</p>
<p>In September 2002, the river overflowed its banks and inundated the pits. The Texas Railroad Commission (RRC) responded with collection of samples from the pits, adjacent residential yards, and from four nearby residential water wells. A site assessment was conducted in March of 2003 by the RRC. Sample results led to the conclusion that the pits posed an unacceptable risk to human health.&nbsp; This evaluation was based on the possibility of direct contact with the waste material.</p>
<p>In October 2004, the United States Environmental Protection Agency (EPA) designated the site as No Further Remedial Action Planned (NFRAP) under Superfund and referred the site to the state for further evaluation. In December 2004, a <a title="Read the contents of the HRS in PDF format" href="///assets/public/remediation/superfund/ballard_pits/pdf0335.pdf">hazard ranking system (HRS)</a> document was prepared for the Ballard Pits site.&nbsp; An HRS score of 13.31 was assigned to this site. The HRS is a scoring system developed by the EPA that is used to evaluate potential threats to human health and the environment from hazardous waste sites. The HRS presents a score from 0 to 100, based on the actual or potential release of hazardous substances that will affect human health or the environment from a site. A <a title="Read the contents of the legal notice in PDF format" href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=139682&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=139682&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=01/13/2006&amp;z_chk=">legal notice</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published on January 13, 2006, in the <em>Texas Register</em> (31 TexReg 316-317) describing the site and <a title="Read the description of proposing a site to the SF registry in the glossary" href="/glossary.html#proposed facility">proposing</a> the site for listing on the state Superfund registry.</p>
<h3 style="background-color:transparent; border:none">Soil</h3>
<p>The site is located in a rural area of active sand and gravel mining where the surface geology consists of sand from the Pliocene Goliad Formation.&nbsp; The two pits that comprise the site were created by sand and gravel mining and are designated the East and West Pits. The TCEQ performed Immediate Removal actions at the West Pit in 2008.&nbsp; This pit has been backfilled to grade after approximately 16,000 tons of waste materials generated from the cleanup of the pit were disposed in an approved waste disposal facility.&nbsp; The East Pit is estimated to have a volume of 30,000 cubic yards.</p>
<p>The constituents which comprise the Chemicals of Concern (COCs) at the Ballard Pits site are found in four of the chemical classes: (1) Metals, (2) Polychlorinated Biphenyls (PCBs), (3) Volatile Organic Compounds (VOCs), and (4) Semi-volatile Organic Compounds (SVOCs).&nbsp; The most prevalent COCs in the soil at the Ballard Pits site are SVOCs and VOCs.</p>
<h3 style="background-color:transparent; border:none">Surface Water</h3>
<p>The pits are within a half mile of the Nueces River, and flood waters have inundated the impoundments in the past. The nearest drinking water intakes, serving 284,601 people, are located more than two miles downstream of the pits. The potential for releases of hazardous substances from the impoundments into the Nueces River is a concern. Removal activities underway at the site are aimed at mitigating this threat in the short term, and eliminating it upon completion of the removal action.</p>
<h3 style="background-color:transparent; border:none">Groundwater</h3>
<p>Groundwater contamination has been detected in site monitoring wells.The TCEQ routinely samples onsite monitoring wells, and up until February 2012 nearby residential wells, to monitor for groundwater impacts from the pits.  All private wells sampled were compared to the federal Maximum Contaminant Levels (MCLs) which represent safe levels for these constituents in drinking water.  To date, no groundwater impacts from COCs attributable to the site have been detected in nearby residential water wells.</p>

<h3 style="background-color:transparent; border:none">Current Status and New Developments</h3>
<p>All removal actions have been completed at the West and East pits. Cleanup of the adjacent utility easement and affected residential properties has also been completed.

An additional area of contamination designated as the North Pit has been confirmed on the northern part of the property. The North Pit is more than a quarter mile away from the nearest residential sector. To date, no contaminants of concern attributable to the site have been detected in neighboring residential water wells or surface water.</p>
<p>The Texas Commission on Environmental Quality (TCEQ or agency)  conducted an <a href="/assets/public/remediation/superfund/ballard_pits/ballard_newsletter10092009.pdf">Open House Availability Session</a> regarding the site on Thursday, October 22, 2009 from 6:30p.m. to 8:30p.m. at the Calallen Middle School located at 4602 Cornett Drive, Corpus Christi, Texas.</p>

    use commercial/industrial criteria in setting cleanup levels based
    on the existing land use of the property, as is prescribed in 30
    TAC Chapter 350, Texas Risk Reduction Program, under
  &sect;350.53.<br />
    A public meeting to receive citizen comments was scheduled for
  February 23, 2006, at the Calallen High School.</li>
  
  <li>February 23, 2006, approximately 50 interested members of the
    community attended the public meeting. No challenges were received
    to the proposal of the Ballard Pits site to the state Superfund
  registry.</li>
  
  <li>July 2006, a work order was issued for the start of the
  remedial investigation.</li>
  
  <li>August 2006, a remedial investigation soil and groundwater
  sampling event was performed.</li>
  
  <li>February 2007, the technical memorandum for the remedial
    investigation was reviewed and approved, completing the remedial
  investigation.</li>

  <li>January 8, 2008, a public meeting was held to inform the
    community of the planned removal action. This removal action is
    designed to prevent the spreading of the contaminated waste
    material to the surrounding property and the possible infiltration
    into the shallow groundwater which is used by adjacent residents
    for their drinking water. The removal action will consist of
  excavation of contaminated soil and waste material.</li>
  
  <li>January 9, 2008, TCEQ staff presented details of the planned
  removal action to the Nueces County commissioners.</li>
  
  <li>March 27, 2008, a community meeting was held at the Calallen
    High School to provide additional information and to answer any
  remaining questions about the planned removal action.</li>
  
  <li>April 2, 2008, TCEQ staff presented additional information
    regarding the planned removal action to the Nueces County
  commissioners.</li>
  
  <li>March 2008, <a title="March 2008 site update" href="/assets/public/remediation/superfund/ballard_pits/ballardnewsletter0308.pdf">
    Site Update Newsletter</a> mailed out to property owners and
  residents.</li>

  <li>May 6, 2008, The TCEQ held a public meeting held at the Johnny
    Calderon Building.&nbsp;&nbsp; TCEQ staff presented information
    regarding the new information discovered during excavation of the
    west pit, why excavation activities would be temporarily suspended,
  <strong></strong>and what actions TCEQ would take to secure the
  site and monitor during the interim.</li>
  
  <li>May 14, 2008, TCEQ staff presented information regarding the
    temporary suspension of the removal action to the Nueces County
  commissioners.</li>
  
  <li>June 27, 2008, a <a href="/assets/public/remediation/superfund/ballard_pits/ballard_crp_608.pdf">
    community relations plan</a> was prepared for the Ballard Pits
  site.</li>
  
  <li>October 14, 2008, <a title="October 2008 site update" href="/assets/public/remediation/superfund/ballard_pits/oct08_ballard_site_update.pdf">
    Site Update Newsletter</a> was mailed out to property owners and
    residents. The removal of waste materials and the backfilling of
    the west pit were completed. Approximately 6,662 cubic yards of
    hazardous waste and 9,335 cubic yards of nonhazardous waste from
    the cleanup of the west pit were disposed of at an approved
  landfill.</li>
  
  <li>November 17&ndash;26, 2008, additional fieldwork was completed to
    further define the nature, extent and treatment options for the
    contamination associated with the east pit. Groundwater samples
    were taken from existing monitoring wells and the residential water
  wells adjacent to the site.</li>
  
  <li>December 17, 2008, the TCEQ presented a project status update
  to the Nueces County commissioners.</li>
  
  <li>December 22, 2008, groundwater samples were collected from off-site monitor wells and residential water wells adjacent to the
  site.</li>
  
  <li>March 2009, the residential wells adjacent to the pits were
    sampled. Subsurface soil samples were also collected in an effort
  to determine the horizontal extent of wastes.</li>
  
  <li>May 13, 2009, began excavation of wastes and the implementation
    of an air monitoring plan. Transportation of wastes for final
  off-site disposal is under way.</li>

    presented a project status update to the Nueces County

  <li>June 10, 2009,  all removal actions have been  completed in the West Pit.&nbsp; Removal  activities are underway at the East Pit with current activities focused on the  excavation and disposal of wastes from the western end of the pit.&nbsp; An Ambient Air Monitoring Plan is being implemented  to monitor the air during the excavation of wastes.Treatability studies are  being refined concurrently with the excavation of wastes in an effort to arrive  at the most efficient and cost-effective approach for remediating the site. </li>
  <li>July 13, 2009, an expanded groundwater sampling event was conducted to sample off-site monitor wells and residential water wells.</li>
  <li>July and August 2009, TCEQ expanded the sampling of neighborhood residential wells and conducted surface water sampling. Data results indicate no contamination from the site has affected any of these drinking water sources. No contamination has been detected in any of the neighboring private wells sampled to date.</li>
  <li>October 12, 2009, a  Site Update <a href="/assets/public/remediation/superfund/ballard_pits/ballard_newsletter10092009.pdf">Newsletter</a> and notice of Availbility Session meeting was mailed out to property owners and residents. </li>

  <li>April 15, 2010<strong>,</strong> A <a href="/assets/public/remediation/superfund/ballard_pits/ballard_ad_041210.pdf">notice</a> of a was published in the <em>Corpus Christi Caller Times</em> announcing a community meeting scheduled for April 22, 2010 from 6:30pm to 8:30pm at Calallen High School, 4001 Wildcat Drive, Corpus Christi, TX.</li>
  <li>April 16, 2010, A <a href="/assets/public/remediation/superfund/ballard_pits/ballard_newsletter_april2010.pdf">newsletter</a> was mailed out to property owners and area residents.</li>
  <li>July 1, 2010, Drinking Water Sampling event was performed the week of June 21,   2010.</li>

  <li>August  2011, A Focused Remedial Investigation for all 297 acres has determined there  are no additional pits. All waste sources representing immediate threats to  human health or the environment have been addressed. The site will continue in  the Superfund process to ensure a long term remedy is selected.&nbsp; Routine groundwater and surface water  sampling will continue to ensure drinking water sources remain unaffected. </li>
  <li>February 20, 2012, Groundwater sampling event was conducted during the week.</li>
  <li>April 2012, A groundwater monitoring event was completed.</li>
  <li>July 2012, The Final Historical Chain of Title and Plat Map, and Superfund Sites B Current Property Owner Report was completed  to support the effort to file a lien on the property.</li>
  <li>September 20, 2012, Development of a Remedial Investigation work plan (RIWP) is in progress to determine vertical extent of contaminants.  The work plan will support installation of three double cased monitoring wells to be completed one each in the second groundwater bearing unit beneath the east, west and north pits.  The RIWP will also address routine groundwater monitoring of existing on-site and off-site monitoring wells, and a study of background groundwater arsenic levels.  The field work is planned for early October 2012. </li>
  <li> December 2012, three new monitoring wells were installed and screened in the second groundwater bearing unit adjacent to each of the pits, and routine groundwater monitoring of the existing monitoring wells at the site was completed.  Water samples from off-site drinking water wells and off-site surface water samples were collected for an arsenic background study.</li>
  <li>March 2013, a scoping meeting in Austin was held to determine requirements for completing an Affected Property Assessment Report (as part of the Remedial Investigation) and initiation of a Feasibility Study.</li>
  <li><strong><a id="latest" name="latest"></a></strong>April 2013, a Remedial Investigation Technical Memorandum was completed that summarized the results of the routine groundwater monitoring event and the arsenic background study as follows:<br />

  <p><strong>Groundwater monitoring</strong> - The groundwater analytical results were consistent with previous results for elevated arsenic levels (levels greater than 0.01 mg/L) in a majority of the wells.  Elevated arsenic levels were detected in the second groundwater bearing unit at two of the new monitoring well locations.  One monitoring well located in the west pit was found to have light non-aqueous phase liquid (LNAPL) in the well and was not sampled.</p>
  <p> <strong>Arsenic background study</strong> - An arsenic concentration of 0.0396 mg/L was determined to represent the upper 95% statistical limit of background arsenic in off-site drinking water wells.  An arsenic concentration of 0.119 mg/L was determined to represent the upper 95% statistical limit of background arsenic in surface water.</p>

<p>The Barlow's Wills Point Plating Company site is located on the south side of   U.S. 80, 3.4 miles east of its intersection with Texas 64 in Wills Point, Van   Zandt County, Texas. The site is a 2.0-acre plot consisting of one metal   building located on a concrete slab. The facility was used for electroplating   operations from early 1987 until early 1990. The electroplating operations   involved nickel-chromium electroplating, zinc-aluminum anodizing, and other   miscellaneous plating lines utilizing copper, silver, or cyanide. The material   generated from these processes included hazardous waste and rinse water as well   as non-hazardous wastes. All wastes were handled on site with no apparent   off-site shipments. Elevated levels of chromium, nickel, zinc, and copper have   been found in the site soils. In March 1990, the site was abandoned with waste   on site, including approximately 133 drums and containers. On August 24, 1990,   all usable equipment was purchased and removed from the site.<br />
</p>




<h3 style="background-color:transparent; border:none"><strong>Superfund Actions   Taken to Date</strong></h3>
<ul type="square">

<li>December 15, 1995, the TNRCC performed a removal action to clean the metal   building of debris and use the cleaned area as a staging area for the old and   overpacked drums. At the same time, a site perimeter fence was constructed to   limit unauthorized access, and signs were posted warning of contamination. </li>

<li>November 12, 1996, a <a href="/assets/public/remediation/superfund/barlow/pdf0260.pdf">legal notice</a> was published in the <em>Texas   Register</em> (21 TexReg   11125-11126) describing the site and <a href="/remediation/superfund/glossary.html#proposed facility">proposing</a> the   site for listing on the state Superfund registry. A public meeting to receive   citizen comments, was to be held at the Wills Point City Hall on December 16,   1996. </li>

<li>June 7, 1999, the TNRCC issued a work order to determine the nature and   extent of 
contamination (remedial investigation). </li>

<li>June 8, 1999, remedial investigation, Phase I, under way. </li>

<li>June 22, 1999, remedial investigation, Phase I, completed. </li>

<li>September 21, 1999, the TNRCC received draft report of remedial   investigation <br />
Phase I. </li>

<li>August 28, 2000, the TNRCC received final report of remedial investigation   Phase I. </li>

<li>January 22, 2001, the TNRCC issued a work order to initiate the removal   action of the remaining contamination. </li>

<li>February 2001, the concrete slab was examined and tested for contamination. </li>

<li>May 2001, the concrete slab was decontaminated. </li>

<li>August 24, 2001, based on investigative technical reports, the TNRCC   concluded that the site does not pose an unacceptable risk to human health or   the environment. No further remedial action is warranted at the site. Conditions   at the site met residential cleanup criteria established by Title 30, Texas   Administrative Code, Chapter 350 (Texas Risk Reduction Program), except for the   area under the concrete slab, which contains nickel above the protective   concentration levels required for residential property. </li>

<li>January 30, 2002, an updated copy of the community relations plan was   prepared for the Barlow's Wills Point Plating site.

</li>

<li>September 1, 2002, effective date of the name change from Texas Natural   Resource 
Conservation Commission (TNRCC) to Texas Commission on Environmental   Quality (TCEQ). </li>

<li>November 20, 2002, a deed notice restriction was filed in the real property   records of Van Zandt County, concerning an environmental use limitation for the   concrete slab at the site. To prevent exposure to the nickel contamination which   remained under the concrete slab, the integrity of the concrete building   foundation on the property must not be disturbed or changed without first   notifying the executive director of the TCEQ and receiving written approval for   the change. The remainder of the two acre site is suitable for residential use. </li>

<li>January 10, 2003, a <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=80165&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=80165&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=01/10/2003&amp;z_chk=">legal notice</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published in the <em>Texas   Register</em> (28 TexReg   501-502) proposing to <a href="/remediation/superfund/glossary.html#deleted site">delete</a> the site   from the state Superfund registry in accordance with 30 TAC §335.344(c) and   inviting public comment on the determination that the site no longer presents an   imminent and substantial endangerment to the public and the environment, and   that no further remedial action is necessary. A public meeting was scheduled   February 20, 2003, at the Wills Point City Hall. </li>

<li>January 21, 2003, an affidavit of lien payable to the commission was filed   in the Van Zandt County real property records by the TCEQ. The lien was filed   pursuant to the Texas Solid Waste Disposal Act, Texas Health and Safety Code   §361.194, to recover the state's remediation expenses. </li>

<li>February 20, 2003, a public meeting was held at the Wills Point City Hall   Hall to receive community comments on the proposal to delete the Barlow's Wills   Point site from the Superfund registry. No further remedial action is warranted   at the site. Conditions at the site met residential cleanup criteria established   by Title 30, Texas Administrative Code, Chapter 350 (Texas Risk Reduction   Program), with the exception of the area under the concrete slab which contains   nickel above the protective concentration levels required for residential   property. </li>

No challenges or comments were received on the determination that   the site no longer posed an imminent and substantial endangerment to public   health and safety or the environment. In accordance with Texas Health and Safety   Code §361.188(d), a notice will be filed in the real property records of Van   Zandt County stating that the site has been deleted from the state Superfund   registry. </li>

</h3>
<p>The Bestplate, Inc. site is located at 1090 South Interstate 45, in the city of   Hutchins, Dallas County, Texas. Operations at the 2.93-acre site began in 1976 and continued until the   company filed for bankruptcy in January 21, 1986. The company manufactured and   plated metal accessories for trucks. An annual inspection by the Hazardous and   Solid Waste Enforcement Section of the Texas Department of Water Resources on   April 19, 1983, revealed unauthorized discharges, averaging  3,000 gallons per   day, of plating waste containing nickel and chromium into the ditch. The waste   had been discharged into a ditch since 1976. Bestplate, Inc. was found to be in   non-compliance with 16 points of the Texas Administrative Code, as well as a   similar number of federal regulations. A Texas Water Commission inspection on   June 11, 1986, revealed that the Bestplate, Inc. complex was abandoned but contained a   substantial quantity of unused product and waste. </p>




<h3 style="background-color:transparent; border:none"><strong>Superfund   Actions Taken to Date</strong></h3>
<ul type="square">

<li>October 16, 1987, a <a href="/assets/public/remediation/superfund/bestplate/bestplate_12texreg3858.pdf">legal notice</a> was published in the <em>Texas   Register</em>, (12 TexReg 3858-3859) <a href="/remediation/superfund/glossary.html#proposed facility">proposing</a> the   site to the state Superfund registry, and announcing that a public meeting to   receive citizen comments would be held at the Trinity River Authority Central   Plant in Grand Prairie on November 10, 1987. </li>

<li>January 22, 1988, a <a href="/assets/public/remediation/superfund/bestplate/bestplate_13texreg427.pdf">legal notice</a> was published in the <em>Texas   Register</em> (13 TexReg 427-428) listing the site on the state Superfund   registry. </li>

<li>October 1989, remedial investigation started. </li>

<li>September 1, 1993, effective date of the creation of the Texas Natural   Resource Conservation Commission from the joining of the Texas Water Commission, the Texas Air Control Board and a portion of the Texas Department of Health. </li>

<li>February 1995, focused feasibility study started. </li>

<li>April 1995, the Final Feasibility Study report was approved, marking completion of the   Remedial <br />
Investigation/Feasibility Study phase. </li>

<li>May 19, 1995, a <a href="/assets/public/remediation/superfund/bestplate/bestplate_20texreg3791.pdf">legal notice</a> was published in the <em>Texas Register</em> (20 TexReg 3791) announcing a public meeting would be held July 6, 1995, at the   Hutchins City Hall Council Chambers to present to the community the best choice   among cleanup remedies and to receive citizen comments to be considered in the   final recommended remedy. </li>

<li>July 6, 1995, a public meeting was held at Hutchins City Hall to receive   comments on the proposed cleanup alternative, which was a combination of waste   management technologies that included chemical decontamination of the concrete   floor, removal and disposal of the concrete in the plating line area,   decontamination of the plating vats by acid treatment, and off-site disposal of   concrete, sediment, and cleaning solutions to reduce all health risks to   acceptable levels for industrial/commercial use. </li>

<li>December 4, 1995, TNRCC issued an administrative order directing the   potentially responsible party to conduct or to fund the remedial design and the   remedial action at the site. The order set cleanup levels, selected the remedy   for cleanup, and established rules, responsibilities and enforcement options for   remedial design/remedial action under the state Superfund process. </li>

<li>September 4, 1997, remedial action started. </li>

<li>January 6, 1998, remedial action completed. </li>

<li>March 5, 1998, an affidavit of lien payable to the commission was filed in   the Dallas County real property records by the TNRCC. The lien was filed   pursuant to the Texas Solid Waste Disposal Act, Texas Health and Safety Code   §361.194, to recover the state's remediation expenses. </li>

<li>May 8, 1998, a <a href="/assets/public/remediation/superfund/bestplate/pdf0080.pdf">legal notice</a> was published in the <em>Texas Register</em> (23 TexReg   4683-4684)   proposing to <a href="/remediation/superfund/glossary.html#deleted site">delete</a> the site   from the state Superfund registry in accordance with 30 TAC §335.344(c) and   inviting public comment on the determination that the site no longer presented an   imminent and substantial endangerment to public health and safety or the   environment.</li>

<li>June 19, 1998, a <a href="/assets/public/remediation/superfund/bestplate/pdf0084.pdf">legal notice</a> was published in   the <em>Texas Register</em> (23 TexReg   6646) officially <a href="/remediation/superfund/glossary.html#deleted site">deleting</a> Bestplate, Inc. from the state Superfund registry in accordance with 30 TAC §335.344(c).   No challenges or comments were received on the determination that the site no   longer presented an imminent and substantial endangerment to public health and   safety or the environment. No further remedial action was planned and the site was returned to industrial/commercial (nonresidential) use. </li>

</h3>
<p>The Butler Ranch site (also known as the J.M. Hackney site in Texas Railroad   Commission records) is located 11.8 miles southwest of Falls City, Karnes county, Texas, off Farm Road   791. This site consists of two abandoned uranium mining pits, about 0.7 mile   apart, that were used for the disposal of industrial solid waste in the early to   mid-1970s. Pit No. 1 is approximately five acres in size and approximately 30   feet deep. Pit No. 2 is approximately one acre in size and averages 20 feet in   depth. TNRCC records indicated that hazardous substances, including styrene tars   and spent catalyst were illegally shipped to the Butler Ranch in September 1974,   for disposal. Investigative reports showed that Pit No. 1 received between nine   and twenty-six 5,500 gallon bulk loads of styrene tars, chlorinated   hydrocarbons, and vinyl chloride tars and between 300 and 400 55-gallon drums of   spent metal catalyst. Pit No. 2 received 200 to 300 55-gallon drums of spent   metal catalyst.</p>

<h3 style="background-color:transparent; border:none"><strong>Superfund   Actions Taken to Date</strong></h3>

<li>January 16, 1987, a <a href="/assets/public/remediation/superfund/butler/butlerranch_12texreg205.pdf">legal notice</a> was published in the <em>Texas   Register</em> (12 TexReg 205-206) describing the site, <a href="/remediation/superfund/glossary.html#proposed facility">proposing</a> the   site to the state Superfund registry, and announcing that a public meeting to   receive citizen comments would be held at the City Auditorium in Karnes City on   February 11, 1987. </li>

<li>January 22, 1988, a <a href="/assets/public/remediation/superfund/butler/butlerranch_13texreg427.pdf">legal notice</a> was published in the <em>Texas   Register</em> (13 TexReg 427-428) listing the site on the state Superfund   registry. </li>

<li>September 1, 1993, effective date of the creation of the Texas Natural   Resource Conservation Commission from the joining of the Texas Water Commission   and the Texas Air Control Board and a portion of the Texas Department of Health. </li>

<li>November 20, 1994, remedial investigation/feasibility study started. </li>

<li>April 15, 1995, the Texas Natural Resource Conservation Commission (TNRCC)   <br />
removed 276 55-gallon drums. More than 800 yards of waste contaminated with   styrene tar contained in drums and soils was also removed. The wastes were found   to include naturally occurring radioactive materials (NORM), and were   subsequently disposed of in a landfill permitted for NORM wastes in Clive, Utah. </li>

<li>June 15, 1999, TNRCC project manager reported the state Superfund remedial   action was substantially complete. </li>

<li>February 4, 2000, TNRCC deferred jurisdiction of the Butler Ranch site to   the Texas Railroad Commission for consideration for mine reclamation using   monies from the Abandoned Mine Reclamation Fund. The Texas Railroad Commission   will track the two former uranium pits as the J.M. Hackney site in Karnes   County. </li>

<li>March 10, 2000, a <a href="/assets/public/remediation/superfund/butler/pdf0078.pdf">legal notice</a> was published in the <em>Texas Register</em> (25 TexReg   2209-2210)   proposing to <a href="/remediation/superfund/glossary.html#deleted site">delete</a> the site   from the state Superfund registry in accordance with 30 Texas Administrative   Code (TAC) § 335.344(c)(6), announcing a public meeting would be held April 13,   2000, at the City Hall in Falls City, and inviting public comment on the   determination that the site no longer presented an imminent and substantial   endangerment to public health and safety or the environment. TNRCC does not plan   any further remedial action. </li>

<li>June 9, 2000, a <a href="/assets/public/remediation/superfund/butler/pdf0006.pdf">legal notice</a> was published in the <em>Texas Register</em> (25 TexReg   5742-5743) officially <a href="/remediation/superfund/glossary.html#deleted site">deleting</a> the site   from the state Superfund registry in accordance with 30 Texas Administrative   Code (TAC) § 335.344(c). No challenges or comments were received on the   determination that the site no longer presented an imminent and substantial   endangerment to public health and safety or the environment. In accordance with   Texas Health and Safety Code §361.188(d), a notice was to be filed 
in the real   property records of Karnes County, stating that the site has been deleted from   the state registry. </li>

<p>The Camtraco Enterprises, Inc. site (the site) is located
at 18823 Amoco Drive in Pearland, Brazoria County, Texas. The site
consists of approximately 3.5 acres of mostly vacant rural land.
Residential properties are located south, west and north of the
site. The site is bounded on all sides by a chain link fence. The
site has been documented in the past as operating as a fuel storage
and fuel blending/distillation facility. The blending/distillation
operation employed six 18,000-gallon tanks, seven 10,000-gallon
tanks, one 36,000-gallon tank and one 2,000-gallon underground
storage tank used as a sump. The company also, at one time, had
accepted barge-cleaning wastes. Investigations identified evidence
of on-site spills, air violations, and buried drums. The site has
been inactive since 1992 and is presently abandoned.</p>

<strong>Superfund Actions Taken to Date</strong></h3>

<li>August 2008, a <a href="/assets/public/remediation/superfund/camtraco/hrs_camtraco.pdf">hazard ranking
system</a> (HRS) document was prepared for the site. </li>
<li>February 6, 2009, a <a href="http://info.sos.state.tx.us/pls/pub/regviewer$ext.RegPage?sl=R&amp;app=9&amp;p_dir=&amp;p_rloc=194327&amp;p_tloc=&amp;p_ploc=&amp;pg=1&amp;p_reg=194327&amp;ti=&amp;pt=&amp;ch=&amp;rl=&amp;issue=02/06/2009&amp;z_chk=">legal notice</a> <a href="http://www.tceq.state.tx.us/help/policies/linking_policy.html"><img src="http://www.tceq.texas.gov/assets/public/remediation/superfund/images/exit.gif" alt="Exit TCEQ Site" border="0" title="exit.gif" /></a> was published in the <em>Texas  Register </em> and<em> Pearland Reporter News</em> (on February 11), describing the site and proposing the site for listing on the state Superfund registry.</li>
<li>February 23-24, 2009, groundwater samples were collected  from on-site monitoring wells. TCE was detected above the residential  groundwater Protective Concentration Level (PCL) in one monitoring well.</li>
<li>February 24-25, 2009, groundwater samples were collected  from off-site residential wells. Lead was detected above the PCL in one well .  That well was re-sampled on March 19, 2009, and the lead level was below the  PCL.</li>
<li>March 19, 2009, a public meeting was held to receive community comments on the proposal of the Camtraco Enterprises, Inc. site for listing on the Texas Superfund registry and the use of a commercial/industrial land classification for remediation of site contamination. </li>
<li>June 15-18, 2009, Remedial Investigation started. On-site soil and   sediment samples were collected. Off-site background&nbsp;groundwater samples&nbsp;from   residential wells and off-site background soil samples were also   collected.</li>
<li>August 3, 2009, groundwater samples were collected from  on-site monitoring wells. Preliminary results indicated TCE was detected above  the PCL in one&nbsp;monitoring well.</li>
<li><a id="latest" name="latest"></a>August 4-5, 2010, groundwater samples were collected from nine residential wells. Lead was detected in one residential well  above the lead PCL. Bottled drinking water was provided to the owner of this well. The well was resampled in September and lead was not detected above its PCL. Groundwater samples were also collected from eight monitoring wells. Trichloroethene (TCE) was detected above the residential groundwater Protective Concentration Level (PCL) in two monitoring wells. Lead was also detected above the residential groundwater PCL in one monitoring well.</li>
<li>December 29, 2010, a <a href="/assets/public/remediation/superfund/camtraco/camtraco_newsletter_dec2010.pdf">newsletter</a> was mailed to residents and property owners.</li>
<li>August 2012, The site had one water well and it was plugged and abandoned in August 2012. All investigative-derived waste (IDW) was properly disposed of off-site. </li>
<li>October 3, 2012, the Remedial Investigation Technical Memorandum (RITM) was prepared to summarize the field activities and analytical results from 2011. Soil samples were collected on-site and off-site in July 2011. The soil sample results showed metals and volatile organic compounds (VOCs) above the commercial/industrial Protective Concentration Levels (PCLs). Groundwater samples were collected on-site and off-site in August 2011. The groundwater sample results showed trichloroethene (TCE) above the PCL. The  Annual Groundwater Monitoring Report was prepared to summarize the quarterly groundwater sampling results from December 2011 to August 2012.   From the 18 monitoring wells, the groundwater sample results showed TCE above the PCL in four monitoring wells and arsenic above the PCL in five monitoring wells. </li>
