Item 1. Docket No. 96-1537-IHW. CHAPARRAL STEEL MIDLOTHIAN, L.P. for a Class 3 Modification to the Permit No. HW-50162 in accordance with 30 TAC Section 305.69. The permit modification will authorize the continued operation of one existing container storage area, one existing pelletizer silo and one existing tank for the storage of industrial hazardous waste. These units have been operating under interim status. The facility is located at 300 Ward Road, Midlothian, Texas, approximately two miles south of U.S. Highway 287, one-fourth mile south of U.S. Highway 67 and 1000 feet west of Ward Road, approximately two and one-half miles southwest of Midlothian, Texas, on approximately 298 acres near Midlothian, Ellis County, Texas. Consideration of a request filed by Occidental Chemical Corporation for reissuance of a Temporary Authorization to operate incinerators, HCIN-2 and HCIN-3, effecting removal of the limit on ash content in the incinerator feed, increasing the hourly allowable emission rates for particulate matter (PM) per incinerator from 0.26 lbs/hr to 3.0 lbs/hr, resulting in a total of 15 tons/year from both incinerators, and increasing hourly emission rates of volatile organic compounds (VOC) per incinerator from 0.01 lbs/hr to 0.02 lbs/hr, resulting a chance from 0.04 tons/yr to 0.08 tons/yr per incinerator. In accordance with 30 TAC 305.69(f)(5)(B)(iii), the authorization is necessary to prevent disruption of ongoing waste management. The facility is located within a 1600-acre tract of land in Harris County, north of State Highway 225 and west of Highway 134 in Deer Park, Texas. (John Clegg)

The proposed rules would incorporate by reference seven federal Maximum Achievable Control Technology (MACT) standards for the control of hazardous air pollutant emissions from specific source categories. The rules would also incorporate the federal General Provisions applicable to these source categories with some changes for consistency with the agency's existing New Source Review Program. Item 1. Docket No. 95-0085-WR. Application by Bexar-Medina-Atascosa Counties WCID No. 1 for an amendment to water rights certificate of adjudication No 19-2130. The applicant seeks a change in the authorized purposes of use of water. Under the certificate the applicant diverts water from Diversion and Medina Lakes in Bandera and Medina Counties. On February 22, 1995, the Commission issued its order in this case. The Commission will consider the remand by the 201st District Court of Travis County in cause No. 95-06230.

SOAH Docket No. 582-96-0763; Consideration of Administrative Law Judge's Proposal for Decision and Order concerning the application of Texas Eastman Chemical Co. for a Class 3 Modification to Permit No. HW-50043 which authorizes operation of an industrial solid waste storage, processing, and disposal facility for management of hazardous wastes and non-hazardous industrial solid wastes in Longview, Harrison County, Texas. Applicant seeks authorization to withdraw the application without prejudice. Recommendation: Dismissal without prejudice. Protestant seeks reimbursement of costs incurred in the permitting process. Recommendation: Motion be overruled. ALJ: Cynthia Hayes.
Adopt Administrative Law Judge's Proposal for Decision and order with corrections as noted by the ALJ, RM/JB, Amendment: Strike from the order those findings that relate to the statues dealing with delegated programs not covered by certain provisions of Texas Law. Consideration of the Administrative Law Judge's Proposal for Decision concerning the Petition of Longbranch Associates, L.P., dba Coppertree Apartments appealing retail water and sewer rates set by the City of Houston for Willow Run Public Service, inc., in Harris County, Texas. Willow Run Public Service, Inc. provides retail water and sewer service to approximately 1,179 customers. Recommendation: Approval of agreed revenue requirements; approve of rate design with rate reflecting potential customer demand on system. ALJ: Kerry Sullivan
