U.S. Highway 67 in Johnson County, Texas. The
treated wastewater would be discharged to
Grassy Creek; thence to Mountain Creek; thence
to Joe Pool Lake in Segment No. 0838 of the
Trinity River Basin. The segment is water
quality limited. The designated uses for
Segment No. 0838 are: contact recreation, high
aquatic life uses, and public water supply.
The City has stated that such a request is
justified in order to prevent potential loss
of life, serious injury and severe property
damage to downstream landowners. The effluent
limits in the draft permit will maintain and
protect the existing instream uses. No
significant degradation of high quality

Item 1. | Docket No. 97-0211-AGR. Consideration of the Request for Commission Review concerning the Executive Director's determination that no comments submitted concerning the application by Jan Pieter DeVries for Permit-by-Rule 03679 demonstrated technical merit. The application concerns the dairy currently authorized under Subchapter B of Chapter 321 of TNRCC rules by Permit No. 03679. The application by Jan Pieter DeVries seeks to transfer authorization to operate from Subchapter B to Subchapter K of Chapter 321 of TNRCC rules, to expand a dairy facility from 800 head to operate at a maximum of 1,100 head and to generate, collect, and treat animal wastewater on-site. Waste will be beneficially disposed of on-site. The facility is located on the east side of County Road 310. From the intersection of Farm-to-Market Road 219 and County Road 317, head west on County Road 317; then south on County Road 311; then south on County Road 310 in Erath County. The facility is in the drainage area of the Leon River Below Proctor Lake in Segment No. 1221 of the Brazos River Basin. |

The application sought authorization to discharge an average of 2.5 million gallons per day of treated wastewater from a proposed poultry processing facility to be located in Camp County, Texas. The Executive Director issued on January 28, 1997 an order dismissing the application with prejudice pursuant to 30 TAC 80.25(b). |
