The permit modification will authorize the continued operation of two surface impoundments, the Aeration Basin and the Stormwater Containment Basin for the storage and processing of nonhazardous industrial solid wastes under Delay of Closure. Docket No. 97-0157-MWD Consideration of a request by the City of Venus for a Temporary Order authorizing the discharge of a maximum of 0.15 million gallons per day from a new wastewater treatment facility located approximately 600 feet east of Farm-to-Market Road 157 and approximately 2,500 feet north of U.S. Highway 67 in Johnson County, Texas. The treated wastewater would be discharged to Grassy Creek; thence to Mountain Creek; thence to Joe Pool Lake in Segment No. 0838 of the Trinity River Basin. The segment is water quality limited. The designated uses for Segment No. 0838 are: contact recreation, high aquatic life uses, and public water supply. The City has stated that such a request is justified in order to prevent potential loss of life, serious injury and severe property damage to downstream landowners. The effluent limits in the draft permit will maintain and protect the existing instream uses. No significant degradation of high quality receiving waters is anticipated.

These units have been operating under interim status. The facility is located at 300 Ward Road, Midlothian, Texas, approximately two miles south of U.S. Highway 287, one-fourth mile south of U.S. Highway 67 and 1000 feet west of Ward Road, approximately two and one-half miles southwest of Midlothian, Texas, on approximately 298 acres near Midlothian, Ellis County, Texas. The applicant seeks a change in the authorized purposes of use of water. Under the certificate the applicant diverts water from Diversion and Medina Lakes in Bandera and Medina Counties. On February 22, 1995, the Commission issued its order in this case. The Commission will consider the remand by the 201st District Court of Travis County in cause No. 95-06230.

Consideration of Northeast Texas Municipal Water District's Motion for Reconsideration and Motion for Rehearing and the City of Longview's Motion for Reconsideration, or in the Alternative, Motion for Rehearing concerning the application of Pilgrim's Pride Corporation for proposed water quality permit no. 03842. The application sought authorization to discharge an average of 2.5 million gallons per day of treated wastewater from a proposed poultry processing facility to be located in Camp County, Texas. The Executive Director issued on January 28, 1997 an order dismissing the application with prejudice pursuant to 30 TAC 80.25(b).
