Consideration of the adoption of proposed amendments to 30 TAC Chapter 101, General Air Quality Rules; Subchapter F, Emissions Events and Scheduled Maintenance, Startup, and Shutdown Activities; Division 3, Operational Requirements, Demonstrations, and Actions to Reduce Excessive Emissions; Sections 101.221 - 101.223; and corresponding revisions to the Texas state implementation plan.

 

The amendments would establish the outcome of proving specific criteria regarding certain unauthorized emissions, and would modify the rules to improve implementation.                   AFFIRM, MODIFY OR SET ASIDE EMERGENCY ORDERS

 

Item 27.    Docket No. 2003-0927-UCR. Consideration of whether to affirm, modify, or set aside the Emergency Rate Increase Order issued by the Executive Director, without a hearing, on October 22, 2003 approving the application of William Sparks, Temporary Manager for Dorothy Howard Upton d/b/a Howard & Son Water Company (Utility), Certificate of Convenience and Necessity (CCN) No. 11123, for an emergency water rate increase in Grayson County, Texas. The order was issued pursuant to Sections 5.508 and 13.4133, Texas Water Code and 30 Texas Administrative Code, Section 35.202. The Utility serves approximately 66 total residential service connections in Grayson County, Texas. The emergency rates approved by the Executive Director only apply to the approximately 29 Utility service connections located outside the corporate limits of Pottsboro, Texas. The Emergency Rate Increase Order issued by the Executive Director authorized a rate increase from a monthly minimum including 1,000 gallons of $2.50 per connection to a monthly minimum including zero gallons of $36.11. The Emergency Rate Increase Order also authorized a rate increase from a gallonage charge of $1.00 per 1,000 gallons to $6.00 per 1,000 gallons. A monthly debt repayment surcharge of $10.00 was also approved to allow the Utility to begin payment to City of Pottsboro, Texas, for services received prior to the effective date of the emergency rates and beginning July 12, 2002. Other service fees and a pass through adjustment clause were also approved. The emergency rates would be effective October 22, 2003 for a period of 15 months or until a final rate is set, whichever occurs sooner. The emergency rate increase requested by the Applicant is necessary to ensure the provision of continuous and adequate services to the Utility’s customers. Item 28.     Docket No. 2003-1214-MWD. Consideration of whether to affirm, modify or set aside an Emergency Order issued after a request by the City of La Joya pursuant to Texas Water Code, Section 5.509 and 30 Texas Administrative Code, Sections 35.301 through 35.303. The Executive Director granted the Emergency Order on October 10, 2003. The Order will expire 180 days after issuance. The Emergency Order increases the amount of land authorized for irrigation under Texas Commission on Environmental Quality Permit No. 12675-001 from 5.2 acres to 51.53 acres at a daily average flow not to exceed 175,000 gallons per day. The City of La Joya is authorized to operate its wastewater treatment facility and to dispose of its treated municipal wastewater through irrigation and evaporation under TCEQ Permit No. 12675-001. The facility is located approximately 1.5 miles south-southwest of the intersection of U.S. Highway 83 and Farm-to-Market Road 2521 in the City of La Joya, Hidalgo County, Texas. The City of La Joya sought the Emergency Order to prevent a possible breach in the levee of the facility’s holding pond, the final pond in a five-pond treatment system, caused by recent heavy rains and, thus, to prevent an uncontrolled release into water in the state. No discharge into water in the state is authorized by this Emergency Order. The discharge is to a field adjacent to the wastewater treatment facility that is not currently permitted. The City of La Joya has the required legal rights from the landowner to use the land for irrigation. The discharge is to land adjacent to unnamed tributaries that flow into the Rio Grande below Falcon Reservoir in Segment No. 2302 of the Rio Grande Basin. (John Williams, Kent Trede)

                  DISTRICTS MATTERS

                  RULE MATTER

 

Item 31.    Docket No. 2003-1399-RUL. Consideration of a petition for rulemaking under 30 TAC Section 20.15.

 

The petition was filed by the Environmental Law and Justice Center on behalf of the Coalition Against Ruffino Trash Transfer Station. The petitioner requests that a provision be added to 30 TAC Section 330.63, Duration and Limits of Permits. The added provision would cause issued municipal solid waste permits to expire automatically if operations at the facility do not commence within five years of permit issuance. Item 3.       Docket No. 2003-1105-IWD. Consideration of a Motion to Overturn concerning the Executive Director’s approval of the renewal of TPDES Permit No. 03021, issued to Tenaska III Texas Partners for its Paris Cogen Facility, a cogeneration power plant. The permit authorizes the discharge of cooling tower blowdown commingled with metal cleaning waste, low volume waste, and storm water runoff at a daily average flow not to exceed 375,000 gallons per day via Outfall 001; and storm water runoff on an intermittent and flow variable basis via Outfall 002. The facility is located 0.1 miles west of U.S. Highway 271 and 0.5 miles north of the intersection of U.S. Highway 271 and U.S. Highway 82, north of the City of Paris, Lamar County, Texas.
