Docket No. 1998-1154-EXE. The Commission will meet in closed session to deliberate the
appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of the
Commission's Executive Director, as permitted by Section 551.074 of the Texas Open
Meetings Act, Chapter 551 of the Government Code. The Commission may also meet in
open session to take action on this matter as required by Section 551.102 of the Texas
Open Meetings Act, Chapter 551 of the Government Code. No action taken on this item.

Docket No. 1999-0024-EXE. The commission will conduct a closed meeting to receive legal
advice and will discuss pending or contemplated litigation, settlement offers, and/or the
appointment, employment, evaluation, reassignment, duties, discipline or dismissal of
specific commission employees, as permitted by Sections 551.071 and 551.074, the Open
Meetings Act, codified as Chapter 551 of the Government code. No final action, decision
or vote with regard to any legal or personnel matter considered in the closed meeting shall
be made in the absence of further notice issued in accordance with Chapter 551 of the
Government Code. No action taken on this item.

Docket No. 1999-0025-EXE. The commission will conduct a closed session to discuss their
duties, roles, and responsibilities as commissioners of the TNRCC pursuant to section
551.074 of the open meetings act, codified as chapter 551 of the government code. The
Commission may also meet in open session to take action on this matter as required by
Section 551.102 of the Texas Open Meetings Act, Chapter 551 of the Government Code.

This meeting is a work session for discussion between commissioners and staff. No public testimony or
comment will be accepted except by invitation of the commission.

Discussion of agency report on enforcement actions for various media including
agriculture, air, industrial and hazardous waste, municipal solid waste, occupational
certification, petroleum storage tanks, public water supply, water quality, and multi-media. Anne Dobbs (Enforcement Division) presented this item. No action taken on this
issue.

Consideration of recent changes to EPA's rules, policies, and guidance regarding
Transportation Conformity and their impacts on the State Implementation Plan. Herb
Williams, OEPAA/ Policy and Regulations Division presented this item. As a result of the
D.C. Court of Appeals finding for the 1999 National Defense Fund suit against the
Environmental Protection Agency, several transportation conformity issues are affected. Mr.
Williams presented documents describing those issues. The affected areas are: on-road mobile
source emissions budgets in submitted SIPs; budgets from disapproved SIPs; grandfathered
transportation projects; non-federally funded transportation projects; and safety margins. Mr.
Williams also presented separate version of plans, outlining federal, state, and local actions in
response to the Court finding. One version was drafted by Texas Department of Transportation
staff and one version was drafted by members of both agencies. No action taken on this issue.

Consideration of activities associated with State Implementation Plans and Regional Clean
Air Strategy. This issue was not presented.

Consideration of the agency's implementation of legislation enacted by the 75th Texas
Legislature, and consideration of the agency's Legislative Implementation Strategy for
legislation enacted by the 76th Texas Legislature. Randy Wood, OEPAA/Deputy Director
and Susi Ferguson OEPAA/Policy Implementation presented this item. Mr. Wood updated the
Commissioners with the status of legislative implementation of the 75th Legislature. The 61
bills that passed produced 76 separate implementation projects. Seventy projects are complete.
Staff described current status of the remaining 6. Progress to date on House Bill 1,
Quadrennial Review, is behind schedule. Staff is evaluating factors involved with the interval
for completion and will be recommending revisions to the existing review plan in the next two
weeks. No action taken on this issue.

Consideration of the agency's legislative proposals and other related issues to be addressed
during the 76th Texas legislative session. The commission may also meet in closed meeting
to receive legal advice regarding these matters, or any of the above matters, as authorized
by Section 551.071 of the Open Meetings Act, Chapter 551 of the Government Code. Any
commission action, decision, or vote on these matters will be made in open meeting in
accordance with Section 551.102 of the Open Meetings Act, Chapter 551 of the
Government Code. Steve Minick (Director/IGR) presented this item. Most of the information
presented is contained in the Management Report describing the previous weeks legislative
activities. No action taken on this item.

Planning for the next Commissioners' Work Session. In addition to standing issues, other
issues identified and scheduled for presentation at the next session on June 25 are NPDES and
Sunset Review.
