NEW BUSINESS

  1. Discussion of the Monthly Enforcement Report for September 2001. Anne Dobbs, OCE, presented this issue. No action taken.


  2. Discussion of Small Business and Local Government Enforcement Report for FY01. Israel Anderson, SBEA, and Kara Dudash, OCE presented this issue. No action taken.


  3. Consideration of the State Water Plan as proposed by the Texas Water Development Board. Leigh Ing, OPRR, Margaret Hoffman, OLS, and Todd Chenoweth, WPRM, discussed this issue. Staff presented the Commissioners with a draft letter containing the agency response to the proposed State Water Plan developed by the Texas Water Development Board. Staff identified issues important to the TNRCC statutory responsibilities regarding policy development relative to inter-basin transfers, water marketing, environmental flows, and water re-use. The commission provided additional comments to the draft letter. The commission directed staff to make amendments to the letter as revised during the public meeting and submit it to the Texas Water Development Board within the comment period ending November 12, 2001.


  4. Consideration and approval of a time table for phase-in of agency name change to Texas Commission on Environmental Quality. Grace Montgomery Faulkner, and Eddie Molina, OAS, presented this issue. The commission approved staff's proposed time table for phase-in of the agency name change as requested.


  5. Consideration of legislative issues potentially affecting the TNRCC and actions taken by the Texas Legislature. The commission may also meet in closed meeting to receive legal advice regarding these matters, or any of the above matters, as authorized by Section 551.071 of the Open Meetings Act, Chapter 551 of the Government Code. Any commission action, decision, or vote on these matters will be made in open meeting in accordance with Section 551.102 of the Open Meetings Act, Chapter 551 of the Government Code. This issue was not discussed.


  6. Planning for the next Commissioners' Work Session. The December 7th work session is cancelled. The next work session will be January 18, 2002. Issues tentatively scheduled to be presented are the staff report on greenhouse gases and the standing issues.

  1. Discussion of Memorandum of Understanding between the Texas State Soil and Water Conservation Board and the Texas Natural Resource Conservation Commission. Margaret Hoffman, TNRCC/OLS and James Moore, Director, Conservation Programs for TSSWCB presented this issue. No action was taken by either agency.


  2. Discussion of joint efforts of the Texas Natural Resource Conservation Commission and the Texas State Soil and Water Conservation Board to implement legislation adopted during the regular session of the 77th Texas State Legislature. Margaret Hoffman, TNRCC/OLS and James Moore, Director, Conservation Programs for TSSWCB presented this issue. No action was taken by either agency.


  3. Discussion of the joint efforts of the Texas State Soil and Water Conservation Board and the Texas Natural Resource Conservation Commission to develop and implement plans to meet goals of Total Maximum Daily Load (TMDLs) for segments impacted by point and nonpoint sources of pollution. Faith Hambleton, TNRCC/TMDLs and Kevin Wagner, TSSWCB, Conservation Programs, presented this issue. No action was taken by either agency.


  4. Update and discussion of current and future projects funded with Clean Water Act Section 319 funds. Linda Brookins, TNRCC/TA and James Moore, Director, Conservation Programs for TSSWCB presented this issue. No action was taken by either agency.


  5. Status report and discussion of 2001 Farm Bill currently being developed by the United States Congress. Clyde Bohmfalk, TNRCC/OEPAA and Bob Buckley, TSSWCB Executive Director, presented this issue. No action was taken by either agency.
