  1. Discussion of the Monthly Enforcement Report for March 2003. Ann McGinley, Enforcement Division, presented this issue.

    No action taken.

  2. Docket No. 2002-1422-RUL. Consideration of the adoption of the rules review and readoption of 30 TAC Chapter 350, Texas Risk Reduction Program. This review is in accordance with Texas Government Code, Section 2001.039, which requires state agencies to review and consider for readoption each of their rules every four years. The proposal was published in the February 14, 2003 issue of the Texas Register (28 TexReg 1533). (Rule Log No. 2003-012-350-WS. Debi Dyer, Policy and Regulations Division presented this issue.

  3. Consideration for approval to publish and to solicit public comment on draft TMDLs for legacy pollutants in the Tidal portion of the San Jacinto River. Faith Hambleton, TMDL Section presented this issue.

  4. Consideration for approval to publish and to solicit public comment on draft TMDLs for legacy pollutants in the Above Tidal portion of the Arroyo Colorado and the Donna Reservoir and canal system. Faith Hambleton, TMDL Section presented this issue.

  5. Consideration of activities associated with State Implementation Plans and issues related to recommendations regarding the 8-hour ozone designations and boundaries. Herb Williams, OEPAA, and Chuck Mueller, SAD, presented this issue. Staff recommended a revision to the 8-Hour Ozone Designation Schedule for TCEQ to follow in order to meet EPA's July 15, 2003 State Designation Recommendations deadline. The revisions to the schedule allow for publishing staff 8-hour ozone designation recommendations on the agency web pages and providing a press release on or about June 12. The Commission will convene a public meeting to consider and take public comment on these designation recommendations following the June 20 work session. The Commission was also presented a review of the recently signed EPA 8-hour ozone implementation rule.

  6. Consideration of legislative issues potentially affecting the TCEQ and actions taken by the Texas Legislature. The commission may consider legislative proposals and approve recommendations for changes to statutory provisions. The commission may also meet in closed meeting to receive legal advice regarding these matters, or any of the above matters, as authorized by Section 551.071 of the Open Meetings Act, Chapter 551 of the Government Code. Any commission action, decision, or vote on these matters will be made in open meeting in accordance with Section 551.102 of the Open Meetings Act, Chapter 551 of the Government Code. Staff was directed to prepare an update on key legislative items of concern to TCEQ for the next work session.

  7. Planning for the next Commissioners' Work Session. The next work session is scheduled for June 20. Issues tentatively identified for discussion are two quadrennial rule review readoptions as well as the standing issues.
