Beneficial Reuse of Treated Wastewater: Rulemaking Comment Period and Public Meeting

June 2019 - TCEQ seeks public comments on the proposed amended rules for the beneficial reuse of treated wastewater.

TCEQ is proposing to amend 30 Texas Administrative Code (TAC) Chapter 222, Subsurface Area Drip Dispersal Systems, and Chapter 309, Domestic Wastewater Effluent Limitation and Plant Siting. This proposed amendment is the result of a petition from the City of Austin, which was granted by TCEQ on May 11, 2016. The petition was made in response to increasing demands on water supplies and decreasing availability of contiguous or neighboring tracts of land that are large enough for domestic wastewater disposal under TCEQ's current rules. This trend currently appears in parts of Central Texas where wastewater discharge to water in the state is restricted by 30 TAC Chapter 213, Edwards Aquifer, and 30 TAC Chapter 311, Watershed Protection.

The proposed amended rules would give an applicant for a Texas Land Application Permit the option to reduce the acreage required for land application of treated domestic wastewater by obtaining a "beneficial reuse credit" that accounts for beneficial reuse (i.e., water that will not go to the applicant's permitted irrigation site). This would allow permittees and applicants to reduce the dedicated land application acreage currently required by rule. The proposed new rules would not be required—they apply only if an applicant chooses to seek a beneficial reuse credit.

The public will have the opportunity to comment on the draft rules during the public comment period, from June 28, 2019, through July 30, 2019. During that time, written comments may be submitted electronically at https://www6.tceq.texas.gov/rules/ecomments/. All comments should reference Rule Project Number 2016-042-309-OW.

Comments must be received on or before July 30, 2019.
