Industrial and Hazardous Waste Rule Updates

July 2020- An industrial and hazardous waste rule project became effective June 11, 2020.

This project:

  • Changes the definition of "solid waste" and waste management regulations to exclude the conversion of plastics and other recyclable material through pyrolysis or gasification.
    • As amended in Texas Health and Safety Code (THSC) Chapter 361 as a result of House Bill (HB) 1953.
  • Revises the rule for the safe management of recalled airbags.
  • Vacates the comparable fuels rule and the gasification rule.
  • Provides requirements for the disposal of coal combustion residuals from electric utilities.
  • Revises rules in Title 30 Texas Administrative Code (30 TAC) Chapter 335.

A separate Rule Project No. 2020-006-305-WS will also implement HB 1953 within the municipal solid waste rules in 30 TAC Chapter 330.
