Temporary Waiver for Electronic Reporting of Unauthorized Discharges and Unanticipated Bypasses
August 2020 – TCEQ is issuing a temporary waiver for electronic submissions of the written reports for unauthorized discharges and unanticipated bypasses until December 21, 2023.
Written reports for unauthorized discharges and unanticipated bypasses were required to be submitted electronically as per Title 40 Code of Federal Regulations Part 127. However, the Environmental Protection Agency does not have a tool available for Texas Pollutant Discharge Elimination System (TPDES) permittees at this time. Therefore, TCEQ is issuing a temporary waiver for electronic reporting.
This waiver applies if the Monitoring and Reporting Requirements section of your TPDES permit includes the following requirement:
“For Publicly Owned Treatment Works (POTWs), effective September 1, 2020, the permittee must submit the written report for unauthorized discharges and unanticipated bypasses that exceed any effluent limit in the permit using the online electronic reporting system available through the TCEQ website unless the permittee requests and obtains an electronic reporting waiver.”
If your POTW has a permit issued between February 1, 2016 and June 1, 2020, you will receive a letter instructing you to continue to submit these written reports on paper until December 21, 2023.
