On behalf of the Texas Commission on Environmental Quality, the Texas Attorney General today filed an Amended Original Petition and Application for Injunctive Relief in the District Court of Travis County against Intercontinental Terminals Company, LLC in Deer Park, to include violations of the Texas Solid Waste Disposal Act and chapter 26 of the Texas Water Code. The Original Petition filed March 22 alleges violations of the Texas Clean Air Act.

“No Texan should have to suffer through what ITC’s neighbors have had to endure this week,” says TCEQ Executive Director Toby Baker. “We’ve asked the attorney general to bring the full weight of the law against ITC with this action.”

The State of Texas requests that the court grant the following relief as allowed by law: a permanent injunction, civil penalties and reasonable attorney fees, court costs, and investigative costs.
