TCEQ approves fines totaling $584,386

The Texas Commission on Environmental Quality today approved penalties totaling $483,002 against 28 regulated entities for violations of state environmental regulations.

Agreed orders were issued for the following enforcement categories: five air quality, one industrial wastewater discharge, one municipal solid waste, one municipal wastewater discharge, eight petroleum storage tank, four public water system, and one water quality.

Default orders were issued for the following enforcement categories: one air quality, one municipal solid waste, four petroleum storage tank, and one public water system.

Included in the total is a fine of $117,900 against EverVest Operating, LLC, for air quality violations stemming from failure to reduce VOC emissions by 95 percent within 60 days after startup, failure to obtain a required operating permit prior to operating emission units, failure to obtain a required authorization prior to constructing or modifying a source of air contaminants, and failure to maintain emission control equipment, at various times from 2014 through 2016.

In addition, on Feb. 11, the executive director approved penalties totaling $101,384 against 39 entities.
