TCEQ Approves Fines Totaling $706,047

The Texas Commission on Environmental Quality today approved penalties totaling $633,091 against 30 regulated entities for violations of state environmental regulations.

Agreed orders were issued for the following enforcement categories: five air quality, one industrial hazardous waste, one industrial wastewater discharge, four multimedia, two municipal solid waste, six municipal wastewater discharge, one petroleum storage tank, one public water system, and three water quality.

Default orders were issued for the following enforcement categories: one multimedia and four petroleum storage tank.

Penalties were also assessed in the water quality category following a hearing at the State Office of Administrative Hearings.

Included in the total is a fine of $171,882 against E.I. du Pont Nemours & Co. for multimedia violations stemming from its failure to prevent releases of hazardous waste at various times between February 2011 and February 2014.

Also included in the total is a fine of $142,063 against BASF Corporation in Brazoria County for air quality violations stemming from failure to prevent unauthorized emissions in September 2015. As part of a Supplemental Environmental Project, $71,031 of the amount will be used by the Houston-Galveston Area Council to replace high-emission buses with new lower emission buses or to retrofit buses with emissions-reducing equipment.

In addition, on Aug. 14, 2018, the executive director approved a total of 30 penalties, totaling $72,956.
