Proposed Beneficial Reuse Credit

The TCEQ has proposed rules that would allow applicants and permittees who provide wastewater for beneficial reuse to reduce the amount of land required to dispose of wastewater

On March 14, 2016, the City of Austin requested that the TCEQ initiate rulemaking to amend 30 Texas Administrative Code (TAC) Chapters 222 and 309. The proposed rules would allow permittees and applicants to rely on the beneficial reuse of treated wastewater when calculating the amount of land required to dispose of wastewater. This would allow permittees and applicants to reduce the dedicated land application acreage currently required by rule.

The public was invited to comment on the petition during the comment period from August 28, 2016 through October 28, 2016. The draft rules were published in the Texas Register Exit the TCEQ on June 28, 2019. A public hearing was held on July 25, 2019. The comment closes on July 30, 2019.
