Subject:  Permit Renewal 

Senate Bill 2049 signed by the Governor on June 9, 1993
changes the time for permit renewals to be reviewed.  Section
382.055 states that a preconstruction permit issued before
December 1, 1991 is subject to renewal review not later than
fifteen years after the date of issuance.  

A preconstruction permit issued on or after December 1, 1991
is subject to renewal review every ten years after the date of
issuance, and for cause, a preconstruction permit issued on or
after December 1, 1991, for a facility at a nonfederal source
may contain a provision requiring the permit to be renewed at
a period of between five and ten years.  

The permit certificates have been changed to provide notice
that the permit will be renewed after ten years.  Guidelines
will be developed to assist in determining when a permit will
be renewed at a period less than ten years.
