P2 Reporting Requirements

Reporting requirements under Texas' Waste Reduction Policy Act (WRPA).

The Waste Reduction Policy Act of 1991 was adopted by the Texas Legislature to prevent pollution in Texas. The TCEQ adopted the corresponding rule under 30 TAC 335 Subchapter Q . This act requires that certain facilities:

  1. prepare a five-year Pollution Prevention (P2) Plan,
  2. submit an Executive Summary of the P2 Plan, and
  3. report annually on their activities to prevent pollution.

The Pollution Prevention Plan must be updated and a new executive summary must be submitted to the TCEQ every 5 years until such time as WRPA no longer applies to the facility.

The TCEQ offers technical assistance, including several documents (available below) that help facilities with WRPA applicability, planning, and reporting requirements.

Facilities should submit their P2 Plan Executive Summaries and Annual Progress Reports by email to p2@tceq.texas.gov or paper copy to:

The P2 Annual Progress Report (APR) may also be submitted online through the State of Texas Environmental Electronic Reporting System (STEERS) during the online reporting period May 15 - July 1. You must have a STEERS account and have registered your P2 ID to submit an online APR. For more information, please see P2 Data Submission, Updating, and Availability.

Applicability

The Waste Reduction Policy Act applies to:

  • Large and small quantity generators of hazardous waste
  • Toxics Release Inventory (TRI ) Form R reporters

Preparing a Plan

The Waste Reduction Policy Act requires facilities to prepare a five-year Pollution Prevention Plan. There is no required format for the plan; however, it must contain certain elements, including:

  • A list of all hazardous wastes and TRI chemicals
  • The activities that generate the waste or TRI chemical
  • An explanation of P2 projects
  • An implementation schedule
  • The measurable P2 goals
  • An employee awareness program
  • A P2 Plan Executive Summary (Word version) or (PDF version)

Once a Pollution Prevention Plan has been developed, a copy of the full plan should be made available at the facility and the Executive Summary, including the Certificate of Completeness and Correctness, should be submitted to the TCEQ

Annual Progress Reports

LQG's and/or TRI Form R reporters are required to prepare a P2 Annual Progress Report, which is due each year on July 1. Find out more about this report.
