The hearing is structured for the receipt of oral or written comments by interested persons. Open discussion will not be permitted during the hearing; however, commission staff members will be available to discuss the proposal 30 minutes prior to the formal hearing, starting at 9:30 a.m. The receipt of formal oral testimony will begin at 10:00 a.m.
The rulemaking would amend 30 Texas Administrative Code §334.48(c) to remove the requirement for all retail service stations to conduct inventory control procedures. Inventory control may still be performed as part of a combined method under 30 TAC §334.50(d)(4) and (d)(9) (i.e. combination of inventory control plus automatic tank gauging or a combination of inventory control plus statistical inventory reconciliation).
