Upcoming Deadline for Phase II (Small) Municipal Separate Storm Sewer Systems (MS4s) Annual Reports

February 2026—Permittees with an active Notice of Intent (NOI) under the Texas Pollutant Discharge Elimination System (TPDES) Phase II (Small) MS4 General Permit, TXR040000, must submit a paper annual report to TCEQ by March 31, 2026.

The TPDES Small MS4 General Permit, TXR040000, was renewed on Aug. 15, 2024. Existing permittees had until Feb. 11, 2025 to renew their authorization. Some renewal applications have been approved; many are still being reviewed. The new NeT-MS4 system has not been set up to accept electronic annual reports yet. Therefore, operators must continue to submit the annual report by paper (hard copy) until further notice is provided by TCEQ. Below is an explanation of how each type of small MS4 should submit their annual report.

Public Notice Reminder – Small MS4s with a public website are additionally required to post their annual report on their website no later than April 30, 2026.

Small MS4s Approved Under the New 2024 General Permit

MS4 operators with an approved NOI under the 2024 Small MS4 General Permit must submit an annual report documenting their activities during the previous calendar year. The annual report should address the period beginning on the day authorization under the 2024 Small MS4 General Permit was obtained and end on Dec. 31, 2025. These permittees should report using the new 2024 MS4 Annual Report Form ( TCEQ-20561, revised January 2026). 

MS4s Still Operating Under the 2019 General Permit

MS4 operators whose 2024 NOI is pending approval must submit an annual report under the 2019 TPDES Small MS4 General Permit. These permittees need to report continued activities from their 2019-approved Stormwater Management Plan. New activities under the 2024 permit cycle that have not begun due to a pending NOI should be indicated as such.

These small MS4s will continue to use the 2019 MS4 Annual Report Template (TCEQ-20561).

Note: MS4s that are still operating under their 2019 authorization should remain consistent and submit their annual report within 90 days of the end of the reporting year they selected for the 2019 permit cycle (permit year, fiscal year, or calendar year).
