TCEQ will offer two identical virtual stakeholder meetings on August 6 and August 8 to solicit feedback on upcoming rule development to create a Section 185 fee program in Texas for the 10-county Dallas Fort-Worth (DFW) and eight-county Houston-Galveston-Brazoria (HGB) severe 2008 eight-hour ozone national ambient air quality standard (NAAQS) nonattainment areas. TCEQ is required to develop and submit Section 185 fee rules to the U.S. Environmental Protection Agency by November 2025. The FCAA requires a penalty fee if an ozone nonattainment area fails to meet its severe or extreme attainment date for an ozone NAAQS. The fee applies to major stationary sources of ozone precursors, including nitrogen oxides and volatile organic compounds.
