Deadline to Renew Your Small Municipal Separate Storm Sewer System (MS4) General Permit Coverage

January 2025 – The Small (Phase II) MS4 General Permit (TXR040000) renewal period ends Feb. 11, 2025. Small MS4 operators that fail to renew by the deadline will be out of compliance which may result in violations and potential fines.

The Texas Commission on Environmental Quality (TCEQ) renewed the Small MS4 General Permit, TXR040000, on Aug. 15, 2024. This permit authorizes stormwater discharges to surface water in the state from small MS4s. Both existing permit holders and new small MS4s must renew or apply for authorization through the NeT-MS4 system by Feb. 11, 2025.

Notice of Intent (NOI)

Before submitting the NOI application, small MS4s must first prepare a Stormwater Management Program (SWPM). TCEQ created a SWPM template designed for Level 1 and 2 small MS4s. Level 3 and 4 MS4 entities can use the template, but please note that these levels have more best management practices (BMPs) requirements. The NOI must be submitted electronically using EPA's Central Data Exchange (CDX) NeT-MS4 application and reporting system . The NOI application fee is $400.

Waiver Option

TCEQ may waive permitting requirements if the small MS4 meets certain requirements listed in Part II Section C of the general permit. Small MS4 operators (existing and new) that are eligible for a waiver must submit the waiver application using EPA's CDX NeT-MS4 system . Waived MS4s do not need to develop a SWPM and there is no application fee.
