Request for Public Comment in Bexar County for TCEQ’s Proposed Amendments to Chapter 115 and Chapter 117

August 2025—Texas Commission on Environmental Quality (TCEQ) has proposed amendments to rules in Chapters 115 and 117 which would affect sites and operators in Bexar County. The comment period for these proposed changes to the rules and the associated State Implementation Plan closes Aug. 25, 2025.

Background

The amendments to Chapter 115 and 117 are proposed to help Bexar county fulfill nonattainment area obligations under the federal Clean Air Act associated with the U.S. Environmental Protection Agency’s air quality standard for ozone. The comment period for these proposed changes to the rules and the associated State Implementation Plan (SIP) closes Aug. 25, 2025.

  • 2025-006-115-AI: Changes in volatile organic compound regulations in Chapter 115 would impact small businesses performing the following activities: degreasing, wipe cleaning with solvents, and coating metal parts. Industrial maintenance and architectural coatings would also be affected. New requirements would be added for gasoline dispensing hoses and nozzles at gas stations.
  • 2025-007-117-AI: Changes in nitrogen oxide (NOX) regulations in Chapter 117 would apply to stationary internal combustion engines, process heaters, ovens, and incinerators located at industrial, commercial, or institutional major sources of NOX in Bexar County. These regulations would apply to sites with the potential to emit 50-100 tons of NOX per year.

If adopted, the compliance date for these rules would be March 1, 2026.

Attend the Public Hearing in San Antonio

TCEQ will offer a combined public hearing for the proposed revisions to Chapter 115, Chapter 117, and SIP.

  • When: Aug. 19 at 7 p.m. CDT
  • Where: Alamo Area Council of Governments board room, 2700 Northeast Loop 410, Suite 101, San Antonio, TX 78217.

The hearing is set up so interested parties can provide their oral or written comments. Individuals may present oral statements when called in order of registration. Open discussion will not be permitted during the hearing; however, TCEQ staff will be available to discuss the proposal 30 minutes prior to the hearing.

The hearing will be conducted in English, and instructions for participating in the hearing will also be provided in Spanish.
