Annual Reporting Requirement: Certain Air Permits
New reporting requirement for certain temporary permits or permits without an expiration date (open-ended). Types of permits to report, instructions for doing so, and information about the new rule.
Requirements for Temporary Permits and Permits That Don’t Expire
There is a new reporting requirement for those with certain temporary permits or permits without an expiration date (open-ended), including certain air permits by rule, standard exemptions, and air quality standard permits. For those permits that are not required to report regularly, permittees now must report the operational status of the permitted activity annually to TCEQ.
The reporting requirement can be found in the Texas Water Code.

. TEMPORARY AND INDEFINITE PERMIT REPORTING. (a) This section does not apply to a person who holds a temporary permit or permit with an indefinite term that has a regular reporting requirement. (b) A person who holds a temporary permit or permit with an indefinite term shall report to the commission annually whether the activity subject to the permit is ongoing.
Deadlines for Reporting
Those with permits that meet the criteria are required to initially report the operational status of the permitted activity by Dec. 31, 2024, for each temporary permit or permit without an expiration date. Then, annual reporting will be required by Dec. 31 of each year.
Permits Subject to New Requirements
The following authorizations meet the criteria and are subject to the statutory reporting requirement:
- Registered Air Permits by Rule and Standard Exemptions
- Certain Air Quality Standard Permits
- Animal Carcass Incinerators
- Boilers
- Concrete Batch Plants with Enhanced Controls
- Electric Generating Units
- Feedmills, Portable Augers, and Hay Grinders (registration required)
- Hot Mix Asphalt Plants
- Marine Loading Operations
- Oil and Gas Handling and Production Facilities
- Permanent Rock and Concrete Crushers
- Pollution Control Projects (nonrule)
- Temporary and Permanent Polyphosphate Blenders
Instructions for Reporting
Permittees will report their operational status electronically through the State of Texas Environmental Electronic Reporting System (STEERS).
Once logged into STEERS, select “Air New Source Review (NSR) Annual Operational Status Report”. For each regulated entity number (RN), the “Operational Status” screen will list the registration numbers. Review each registration number and select “Yes” or “No” to indicate if each permitted activity is still operational.
