Air PBR 106.433: Surface Coat Facility

Surface coating or stripping facilities, excluding vehicle repair and refinishing shops are permitted by rule if the facility meets the conditions stated in 30 TAC Sections 106.4 and 106.433. This PBR must be approved before construction begins. Recordkeeping requirements are discussed. This page gives a brief overview of this PBR and links to relevant rules and forms.

To qualify for this PBR, the facility must meet the following criteria:

  • No facilities at vehicle repair and refinishing shops.
  • Outdoor coating operations must be conducted at least 50 feet from the property line and at least 250 feet from any recreational area, residence, or other structure not occupied or used solely by the owner or operator of the facility or the owner of the property upon which the facility is located.
  • The general conditions stated in 30 TAC Section 106.4

  • The specific conditions of 30 TAC Section 106.433
    • Complete PBR 106.433 Checklist, TCEQ Form – 10137, to determine if the facility meets the specific conditions for this PBR.

Starting November 1, 2024, the Surface Coating Workbook will be required to be submitted with all registrations under 30 TAC Sections 106.431, 106.432, 106.433, 106.434, 106.435, and 106.436.

Applications received on or after November 1, 2024, must use Version 1.0 or newer. If this version number does not match the version number listed on the Cover sheet of the workbook, please clear your browser cache and or refresh your screen.

Registration

This PBR must be approved before construction begins and a registration fee is required.

Recordkeeping

Under 30 TAC Section 106.8, your records must identify the rules under which your facility is operating and demonstrate compliance for a rolling 12-month period. Be sure you keep at least these records:

  • a copy of Section 106.4
  • a copy of Section 106.433
  • Records documenting compliance with the above rules.

These records must be kept on site and readily available on request for inspection by the TCEQ or any air pollution control program that has jurisdiction. If you have questions about the type of records you should keep, contact the Air Program in the TCEQ regional office.
