Air Permits Rule and Non-Rule Projects

NEW Amendment to 30 TAC 116, Control of Air Pollution by Permits for New Construction or Modification and corresponding revisions to the state implementation plan (SIP).

TCEQ adopted changes to the standard permit rules for concrete batch plants under 30 TAC Section 116.605.

These changes are based on two new state laws (Senate Bill 763 and Senate Bill 2351), which require TCEQ to update its timelines for conducting protectiveness reviews and issuing and reviewing standard permits for certain types of permanent concrete batch plants.

To follow the new requirements set by Senate Bills 763 and 2351, TCEQ adopted changes to its rules in 30 TAC Chapter 116, Subchapter F, Standard Permits. The changes include:

  1. Adding a requirement for TCEQ to conduct a protectiveness review of the standard permit for permanent concrete batch plants at least once every eight years.
  2. Adding requirements that apply when TCEQ updates the standard permit for permanent concrete batch plants allowing TCEQ to require application updates for facilities that have not yet started construction and have asked for more time to begin construction.

This amendment was subject to a 30-day comment period which ended November 25, 2025.

The amended 30 TAC §116.605 is adopted without change to the proposed text as published in the October 24, 2025, issue of the Texas Register (50 TexReg 6986). These amended rules will be submitted to the United States Environmental Protection Agency as a revision to the SIP.

Issued Renewal and Revision of the Oil and Gas (O&G) General Operating Permits (GOPs) Numbers 511, 512, 513, and 514

TCEQ issued renewed and revised O&G GOPs Nos. 511, 512, 513, and 514 on October 15, 2025. The renewed and revised GOPs were proposed on February 28, 2025, and the public comment period closed on March 31, 2025. One positive comment was received. Please refer to the Statements of Basis for more detailed descriptions of the revisions and the comment.

Current permit holders are required to submit an application for a new authorization to operate (ATO) no later than January 12, 2026, if any of the emission units, applicability determinations, or the basis for the applicability determinations are affected by the revisions in the renewed GOPs. If the revisions in the GOPs do not affect your site, a new ATO is not required. If you have questions about your permit, please contact the Air Permits Division at (512) 239-1250.

Proposed Renewal and Revision of the Air Curtain Incinerator (ACI) General Operating Permit (GOP) Number 518

TCEQ is proposing the renewal and revision of the ACI GOP No. 518.

The draft GOP contains revisions based on recent federal rule changes, which include updates to the Statement of Basis, the requirements tables, and updates to the terms. This renewal also corrects typographical errors and updates language for administrative preferences.

Non-Rule Air Quality Standard Permit for Temporary Public Works Projects

Effective June 18, 2025, TCEQ issued a new non-rule air quality standard permit for temporary concrete batch plants that support public works projects. The new standard permit implements a requirement of Senate Bill (SB) 1397, 88th Session, that TCEQ issue a standard permit for these types of facilities. The new standard permit was issued under the specific authority of Texas Health and Safety Code, Section 382.05195, Standard Permit; Section 382.051985, Standard Permit for Certain Temporary Concrete Plants for Public Works; and 30 Texas Administrative Code Chapter 116, Subchapter F, Standard Permits. The standard permit includes emission control requirements, best management practices, and recordkeeping requirements to ensure the standard permit is protective of human health and the environment and is enforceable.

Proposed OOOOc Rulemaking and State Plan for Existing Crude Oil and Natural Gas Facilities

December 20, 2024: Update to Stakeholder Comment Deadline for Proposed OOOOc Rulemaking and State Plan for Existing Crude Oil and Natural Gas Facilities

TCEQ has extended the deadline to receive stakeholder comments on the proposed OOOOc rulemaking project to January 15, 2025. TCEQ will review all comments we receive but will not formally respond. Comments received after January 15, 2025, may not be evaluated or considered during the rule development process.

December 20, 2024: Update to TCEQ Stakeholder Input Opportunities for Proposed OOOOc Rulemaking and State Plan for Existing Crude Oil and Natural Gas Facilities

Outside of written stakeholder comments, TCEQ will be soliciting additional information through a web-based survey form that will be released at a later date. More information will be coming soon.

The intent of the survey is to gather information on existing oil and gas facilities that may be impacted by this rule, including any information necessary to determine whether standards of performance or compliance schedules should differ from the emission guidelines of Subpart OOOOc.
