NEW February 28, 2025: Request for Public Comments and Hearing Announcement on Oil and Gas General Operating Permits 511, 512, 513, and 514

TCEQ is proposing the renewal and revision of the Oil and Gas (O&G) General Operating Permits (GOPs) Numbers 511, 512, 513, and 514. TCEQ is providing an opportunity for public comment and notice of comment hearing on the draft O&G GOPs. The draft GOPs contain revisions based on recent federal and state rule changes, which include updates to the Statement of Basis, the Periodic Monitoring, the requirements tables, the addition of new requirements tables, and updates to the terms. This renewal also corrects typographical errors and updates language for administrative preferences.

The draft GOPs are subject to a 30-day comment period. Public comments will be accepted from February 28, 2025, through March 31, 2025.

TCEQ will hold a hybrid in-person and virtual public hearing on the draft GOPs on March 31, 2025.

NEW February 24, 2025, Renewal and Revision of Municipal Solid Waste Landfill General Operating Permit 517

The Texas Commission on Environmental Quality (TCEQ) issued renewed and revised GOP Number 517 on February 24, 2025. The renewed and revised GOP was proposed on August 16, 2024, and the public comment period closed on September 16, 2024. As a result of public comment, several clarifications and corrections were made within the permit conditions and terms. Please refer to the Statement of Basis for a more detailed description of the revisions.

Current permit holders are required to submit an application for a new authorization to operate (ATO) no later than May 24, 2025, if any of the emission units, applicability determinations, or the basis for the applicability determinations are affected by the revisions in the renewed GOP. If the revisions in the GOP do not affect your site, a new ATO is not required. If you have questions about your permit, please contact the Air Permits Division at (512) 239-1250.

NEW December 20, 2024: Update to Stakeholder Comment Deadline for Proposed OOOOc Rulemaking and State Plan for Existing Crude Oil and Natural Gas Facilities

TCEQ has extended the deadline to receive stakeholder comments on the proposed OOOOc rulemaking project to January 15, 2025. TCEQ will review all comments we receive but will not formally respond. Comments received after January 15, 2025, may not be evaluated or considered during the rule development process.

NEW December 20, 2024: Update to TCEQ Stakeholder Input Opportunities for Proposed OOOOc Rulemaking and State Plan for Existing Crude Oil and Natural Gas Facilities

Outside of written stakeholder comments, TCEQ will be soliciting additional information through a web-based survey form that will be released at a later date. More information will be coming soon.

The intent of the survey is to gather information on existing oil and gas facilities that may be impacted by this rule, including any information necessary to determine whether standards of performance or compliance schedules should differ from the emission guidelines of Subpart OOOOc.

NEW December 9, 2024: Update to TCEQ Stakeholder Input Opportunities for Proposed OOOOc Rulemaking and State Plan for Existing Crude Oil and Natural Gas Facilities

TCEQ has prepared a web-based survey to collect input in support of our solicitation of informal comments on proposed rulemaking to add a new Division 7 to Chapter 113, Subchapter D, to implement the requirements of 40 Code of Federal Regulations Part 60, Subpart OOOOc.

NEW November 15, 2024: Updated Notice of Stakeholder Meetings on Proposed OOOOc Rulemaking and State Plan for Existing Crude Oil and Natural Gas Facilities

TCEQ has confirmed the meeting location for the November 20, 2024, stakeholder meeting. TCEQ has also added a fourth stakeholder meeting on December 9, 2024, to be held virtually. The stakeholder meetings are held to solicit informal comments on proposed rulemaking to add a new Division 7 to Chapter 113, Subchapter D, to implement the requirements of 40 Code of Federal Regulations Part 60, Subpart OOOOc.

NEW October 7, 2024: Notice of Stakeholder Meetings on Proposed OOOOc Rulemaking and State Plan for Existing Crude Oil and Natural Gas Facilities

TCEQ will hold three stakeholder meetings in November 2024 to solicit informal comments on proposed rulemaking to add a new Division 7 to Chapter 113, Subchapter D, to implement the requirements of 40 Code of Federal Regulations Part 60, Subpart OOOOc.

The proposed rulemaking will address applicability, emission standards, monitoring, recordkeeping, testing, and reporting requirements for designated oil and gas facilities. The rules would set emission standards and/or control requirements for emissions of greenhouse gases (primarily methane) from existing facilities in this industry.

A formal public meeting and comment period will occur on a date following the stakeholder meetings. Additional information can be found on the 2024 OOOOc Rulemaking and State Plan for Existing Crude Oil and Natural Gas Facilities webpage.

NEW March 1, 2024: Title V Federal Operating Permit STEERS Submissions

On January 1, 2023, the Air Permits Division (APD) began requiring all Title V federal operating permit applications be submitted through Title V STEERS. For an application to be considered submitted and to begin processing, it must be submitted using the Title V module in ePermits. Any application sent in via another method will not be logged for processing, will not receive an application shield and revision changes cannot be operated.

November 4, 2022: Title V Operating Permit Applications Accepted in STEERs

The Air Permits Division has added Title V Federal Operating Permit (FOP) project submission capabilities to the State of Texas Environmental Electronic Reporting System (STEERS). In addition, all OP-Notify projects will be processed through STEERS with same day acknowledgement. Beginning January 1, 2023, all FOP application submissions are required to be submitted through STEERS. For all submittals through STEERS, the Responsible Official (RO) or Duly Authorized Representative (DAR) will submit and certify the Title V project without submitting a separate OP-CRO1 certification form. Any application updates can be submitted and certified through STEERS by the RO/DAR or updates can be emailed by the technical contact/consultant which will require a follow up certification with an OP-CRO1 form through STEERS or hard copy.

May 6, 2022: Revision to the Title V PBR Programmatic Approach

TCEQ is revising the permit by rule (PBR) programmatic approach to Title V permits to further clarify the PBR monitoring requirements. Beginning August 1, 2022, all site operating permit (SOP) and general operating permit (GOP) applications for initial and renewal projects, and revisions with PBR updates will be required to include the revised Permits by Rule Supplemental Table ( Form OP-PBRSUP). May 14, 2021: New Public Notice Email Box

The Office of Chief Clerk has created a dedicated email box for applicants and their representatives to submit public notice documents. The email address is PROOFS@tceq.texas.gov. Applicants may submit their proofs of publication, affidavits of publication, and verification forms by email, by regular mail, or by hand delivery. Please note, it is not necessary for an applicant to send the documents via email and then also send original documents by another method. All notice documents submitted to the OCC should be emailed to PROOFS@tceq.texas.gov or mailed to: Texas Commission on Environmental Quality, Office of the Chief Clerk, MC-105, Attn: Notice Team, P.O. Box 13087, Austin, Texas 78711-3087.
