Air Quality Standard Permit for Temporary Hot Mix Asphalt Plants

The Air Quality Standard Permit for Temporary Hot Mix Asphalt Plants is authorized under the Texas Health and Safety Code Section 382.05195 .

To qualify for this standard permit, the facility must meet the following criteria:

  • Plant will operate at one location for 180 days or supply asphalt to a single public works project.
  • Produce asphalt at a rate no greater than 400 tons per hour (cold mix is not allowed).
  • Plant will be 100 feet to 650 feet from the nearest property line (the distance requirement is based on daytime only production, all-hours production, production rate, and asphalt volatility).
  • The conditions of this standard permit and its criteria.
    • Complete the Hot Mix Asphalt Plant Checklist, TCEQ Form – 20110, to determine if the plant meets the relevant conditions of this standard permit.

Please note that although the standard permit may include instructions to submit relocation requests to the regional office, as of September 1, 2024, all relocation requests are to be submitted to the Air Permits Division.
