Air PBR 106.533: Water and Soil Remediation

Remediation facilities are permitted by rule if the facility meets the conditions stated in 30 TAC Sections 106.4 and 106.533. This page gives a brief overview of this PBR and links to relevant rules, forms, and guidance.

To qualify for this PBR, the facility must meet the following criteria:

Notification

Notification is required for remediation projects. Notification must be submitted before pilot test wells begin operation, and then should be updated before commencement of treatment or if emission controls facilities are changed.

Please note that although the PBR may include instructions to submit notification requests to the regional office, as of September 1, 2024, all notification requests are to be submitted to the Air Permits Division.

Recordkeeping

Under 30 TAC Section 106.8, your records must identify the rules under which your facility is operating and demonstrate compliance. Be sure you keep at least these records:

  • a copy of Section 106.4
  • a copy of Section 106.533
  • The following minimum records of sampling or monitoring must be maintained:
    • sample time and date;
      monitoring results (ppmv);
      corrective action taken, including the time and date of the action;
      process operations occurring at the time of sampling;
      records of compliance with the emission rate limits of this section;
      a record of the demonstration that the chosen control method is an appropriate choice for the site; and
      a record of the return receipt demonstrating notification to the appropriate regional office, local air pollution control programs having jurisdiction over the site, and appropriate remediation program.

These records must be kept on site and readily available on request for inspection by the TCEQ or any air pollution control program that has jurisdiction.
