Texas Local Emergency Planning Committee (LEPC) Grant Program
The Texas LEPC Grant Program is an opportunity for LEPCs to receive grant funds to help implement the requirements of the Emergency Planning and Community Right-to-Know Act (EPCRA).
The Texas Legislature transferred the Tier II Chemical Reporting Program to the Texas Commission on Environmental Quality (TCEQ) from the Texas Department of State Health Services in the 84th Texas Legislative Session. The statutory requirements for the Tier II Chemical Reporting Program can be found in the Texas Health and Safety Code 505.016(d), 506.017(d), and 507.013(d). These chapters authorize up to 20% of chemical reporting fees to be awarded as grants to the LEPCs to assist them in fulfilling their responsibilities under the Emergency Planning and Community Right-to-Know Act (EPCRA).
Eligibility and Award Amounts
The funds for the Texas LEPC Grant Program are appropriated to the TCEQ by the Legislature and are subject to change annually. This grant round is up to $475,000 total for all awards.
This grant will allow LEPCs to establish, maintain, and/or improve their implementation of EPCRA. Only LEPCs that are officially recognized by the State Emergency Response Commission (SERC) are eligible for this grant.
Applications are reviewed and awarded at TCEQ’s discretion. Priority will be given to first-time grantees that are unfunded, requesting items that preserve life and safety. Any funds awarded will first be allocated towards items that preserve life and safety.
TCEQ is not obligated to select applications for funding, even if received within the application deadline. TCEQ may also select parts of a proposal for funding and may offer to fund less than the dollar amount requested in a proposal.
Timeline and Deadlines
- The application deadline is October 11, 2024.
- Grant Contracts will be sent out for signature to applicants who receive awards. A signed contract must be returned to the TCEQ within 30 days.
- Submit initial Financial Status Report (FSR) to allow upfront funding within 30 days of receiving your notice to proceed email.
- Quarterly Reports must be completed for each of the reporting periods specified below. The first quarterly report will have the same effective date as the contract, but match the end date of the applicable quarter. For example, if your contract is effective on March 25, your first quarterly report will be from March 25 to May 31 and be due on June 15.
- Quarterly Financial Status Report for March 1 to May 31 – Due by June 15
- Quarterly Financial Status Report for June 1 to August 31 – Due by September 15
- Quarterly Financial Status Report for September 1 to November 30 – Due by December 15
- Quarterly Financial Status Report for December 1 to February 28/29 – Due by March 15
- Purchasing deadline: by August 31, 2026
- Contract Extension Requests Due: by July 1, 2026
- Contract End Date: August 31, 2026
