Stakeholder Meeting RCRA Rule Package 2 Agenda
This stakeholder meeting will seek informal input on Rule Project No. 2019-086-335-WS prior to proposal. The rulemaking will revise Title 30, Texas Administrative Code (30 TAC), Chapters 335 to adopt the following changes made by the Environmental Protection Agency (EPA) to the Code of Federal Regulations (CFR):

Hazardous Waste Generator Improvements

- The EPA published the Rule adoption in the Federal Register at 81 FR 85732, with an effective date of May 30, 2017.

2018 Definition of Solid Waste (DSW) Response to Court Vacatur Rule
- The EPA published the Rule adoption in the Federal Register at 83 FR 24664, with an effective date of May 30, 2018.

Management Standards for Hazardous Waste Pharmaceuticals and Amendment to the P075 Listing for Nicotine Rule
- The EPA published the Rule adoption in the Federal Register at 84 FR 5816, with an effective date of August 21, 2019.
In addition to the adoption of federally mandated revisions, the rulemaking and stakeholder group will address a state-initiated revision to increase the fee schedules for the generation fee (30 TAC 335.323) and the industrial solid waste and hazardous waste management fee (30 TAC 335.325).

All informal comments received at and following the meeting, will be reviewed. TCEQ staff is specifically soliciting comments on the revised definition of solid waste, codification and restructuring of generator rules, management standards for hazardous waste pharmaceuticals, and fee increases.
This is an opportunity to provide informal comments to staff prior to the formal rulemaking process. While staff will review all comments received, the TCEQ will not formally respond to any informal comments. A formal public rule hearing will be scheduled following rule proposal by the Commission.
