Annual Reporting Requirement: Municipal Solid Waste Facilities with a Notification of Intent

Requirements for Temporary Permits and Permits That Don’t Expire

There is a new reporting requirement for those with certain temporary permits or permits without an expiration date (open-ended), including MSW facilities authorized by a Notification of Intent. For those permits that are not required to report regularly, permittees now must report the operational status of the permitted activity annually to TCEQ.  

Note: “permit” is being used in the general sense and means permit, approval, registration, or other form of TCEQ authorization.

The reporting requirement can be found in the Texas Water Code.

Sec. 5.587 . TEMPORARY AND INDEFINITE PERMIT REPORTING. (a) This section does not apply to a person who holds a temporary permit or permit with an indefinite term that has a regular reporting requirement. (b) A person who holds a temporary permit or permit with an indefinite term shall report to the commission annually whether the activity subject to the permit is ongoing.

Deadlines for Reporting

Municipal solid waste facilities authorized by a Notification of Intent are required to initially report the operational status of the permitted activity by Dec. 31, 2024, for each temporary permit or permit without an expiration date. Then, annual reporting will be required by Dec. 31 of each year. 

Instructions for Reporting

Permittees will report their operational status electronically through the State of Texas Environmental Electronic Reporting System (STEERS). STEERS functionality, as well as guidance to assist with reporting, will be available in the fall of 2024.
