Types of Municipal Solid Waste Landfills
MSW landfill facilities in Texas may consist of Type I landfill units for disposal of all types of municipal solid waste, or Type IV landfill units for disposal limited to brush, construction and demolition waste, and rubbish. A landfill facility may contain both types of units.
A permit is required for a landfill according to 30 TAC 330.7 .
Landfill units at small facilities in arid regions that meet the requirements in 30 TAC 330.5(b) for arid exempt (AE) status are designated Type IAE landfill units and Type IVAE landfill units, and are exempt from liner and groundwater monitoring requirements.

Preparing and Submitting an Application
The permit application for a municipal solid waste facility is divided into Parts I, II, III, and IV. All parts must be submitted before an application may be declared administratively complete according to 30 TAC Chapter 281 . To apply for a landfill permit or permit amendment, submit the forms listed in the following sections, along with the information required by 30 TAC Chapter 330, Subchapter B .
Please submit applications electronically, in addition to submitting paper copies.
Note: If delinquent fees or penalties of $25 or more are associated with an applicant's Customer Number (CN), we are required to suspend processing of the application until payment is made.

Public Notice
Applications for permits require public notice. Determine which type of notice is required, and if it must be published in an alternative language.
Other Permits Required
Owners or operators of municipal solid waste transfer stations must also obtain permits for air emissions and stormwater and wastewater discharges, as applicable, according to 30 TAC 330.55 .
Site Assessment by TCEQ
TCEQ is required by 30 TAC 330.73(c) to conduct a site assessment before issuing a new landfill permit or a landfill permit major amendment of the type described in 30 TAC 305.62(j)(1) , to confirm information in the application.
