Air PBR 106.496: Air Curtain Incinerators

Air curtain incinerators are permitted by rule if the facility meets the conditions of 30 TAC Section 106.4 and 106.496. This page gives a brief overview of this PBR and links to relevant rules, forms, and guidance.

To qualify for this PBR, the facility must meet the following criteria:

Registration

This PBR requires an initial registration using the Core Data Form and Form PI-7. A registration fee is required for an initial registration.

Notification

Effective May 1, 2025, all relocation and notification requests must be submitted through STEERS.

A PBR that has been previously registered with this section and is being relocated to a new site, other than a landfill, shall notify Air Permits Division.

The following should be included in the STEERS submittal:

  • For notifications only:
    • APD Relocation/Notification Form, TCEQ Form – 20122
    • Any supporting documentation demonstrating compliance with the permit by rule (i.e. plot plan, area map, etc.)
    • No fee is required.
  • For registration:
    • Permit by Rule (PI-7), TCEQ Form - 10228
    • Any supporting documentation demonstrating compliance with the permit by rule (i.e. plot plan, area map, etc.)
    • A registration fee is required.

Recordkeeping

Under 30 TAC Section 106.8 and 30 TAC Section 106.496 , your records must identify the rules under which your facility is operating and demonstrate compliance for a rolling 12-month period. Be sure you keep at least these records:
