Numerical Index to Air Permits by Rule
A permit by rule is the state air authorization for activities that produce more than a de minimis level of emissions but too little for other permitting options. If you know the number of a PBR, use this index to find it and learn more about it.
Air PBR 106.102: Comfort Heating
Combustion units that are designed and used exclusively for comfort heating purposes and use liquid petroleum gas; natural gas; solid wood; or distillate fuel oil are permitted by rule under 30 TAC Section 106.102. No registration or recordkeeping is required.
Air PBR 106.122: Bench-Scale Laboratory Equipment
Bench-scale laboratory equipment and laboratory equipment used exclusively for chemical and physical analyses is permitted by rule under 30 TAC Section 106.122. No registration or recordkeeping is required.
Air PBR 106.124: Pilot Plants

Air PBR 106.141: Batch Mixers
Batch mixers using drums with a capacity of 27 cubic feet or less for mixing cement, sand, aggregate, lime, gypsum, additives, and/or water to produce concrete, grout, stucco, mortar, or other similar products are permitted by rule under Title 30, Texas Administrative Code (30 TAC) Section 106.141.

Air PBR 106.225: Semiconductor Manufacturing
Modifications, additions, or relocations of equipment (excluding add-on controls) used for semiconductor-manufacturing operations that result in the addition, increase, or substitution of an air contaminant are permitted by rule provided the conditions of this section are satisfied.

Facilities, including drying or curing ovens, and hand-held or manually operated equipment, used for manufacturing, refinishing, and/or restoring wood products are permitted by rule if they meet the conditions stated in 30 TAC Sections 106.4 and 106.231. Air PBR 106.241: Slaughterhouses
Any facility where animals or poultry are slaughtered and prepared for human consumption are permitted by rule if they meet the conditions stated in 30 TAC Sections 106.4 and 106.241. No registration or fee is required. Recordkeeping requirements are discussed.
Air PBR 106.242: Food Preparation
Equipment used in eating establishments for the purpose of preparing food for human consumption is permitted by rule under 30 TAC Section 106.242. No registration or recordkeeping is required.
Air PBR 106.243: Smokehouses
Smokehouses in which the maximum horizontal inside cross-sectional area does not exceed 100 are permitted by rule if they meet the conditions stated in 30 TAC Sections 106.4 and 106.243. No registration or fee is required. Recordkeeping requirements are discussed.
Air PBR 106.244: Ovens, Barbecue Pits, and Cookers
Ovens, mixers, blenders, barbecue pits, and cookers if the products are edible and intended for human consumption are permitted by rule under 30 TAC Section 106.244. No registration or recordkeeping is required.

Air PBR 106.264: Replacements of Facilities
A facility that replaces an existing facility and meets the conditions stated in 30 TAC Sections 106.4 and 106.264 is permitted by rule. The TCEQ must be notified of the replacement within 10 days. Recordkeeping requirements are discussed.
Air PBR 106.265: Hand-held and Manually Operated Machines
Hand-held or manually operated equipment used for buffing, polishing, carving, cutting, drilling, machining, routing, sanding, sawing, surface grinding, or turning of ceramic art work, ceramic precision parts, leather, metals, plastics, fiber board, masonry, carbon, glass, graphite, or wood is permitted by rule under 30 TAC Section 106.265. No registration or recordkeeping is required.
Air PBR 106.266: Vacuum Cleaning Systems
Vacuum cleaning systems used exclusively for industrial, commercial, or residential housekeeping purposes are permitted by rule under 30 TAC Section 106.266. No registration or recordkeeping is required.
Air PBR 106.281: Feed Milling
Modifications to feed milling facilities are permitted by rule if the modifications meet the conditions stated in 30 TAC Section 106.281 and the facility meets the general conditions in 30 TAC Section 106.4. No registration or fee is required. Recordkeeping requirements are discussed.
Air PBR 106.283: Grain Handling, Storage, and Drying

Air PBR 106.301: Aqueous Fertilizer Storage
All aqueous fertilizer storage tanks are permitted by rule under 30 TAC Section 106.301. No registration or recordkeeping is required.

Equipment used exclusively for rolling, forging, pressing, drawing, spinning, or extruding either hot or cold metals by some mechanical means are permitted by rule under 30 TAC Section 106.317. No registration or recordkeeping is required.
Air PBR 106.318: Die Casting Machines
Die casting machines are permitted by rule under 30 TAC Section 106.318. No registration or recordkeeping is required.
Air PBR 106.319: Foundry Sand Mold Forming Equipment
Foundry sand mold forming equipment to which no heat is applied is permitted by rule if it meets the conditions stated in 30 TAC Sections 106.4 and 106.319. No registration or fee is required. Recordkeeping requirements are discussed.
Air PBR 106.320: Miscellaneous Metallic Treatment
Electrically heated or sweet natural gas- or liquid petroleum gas-fueled equipment used exclusively for heat treating, soaking, case hardening, or surface conditioning of metal objects, such as carbonizing, cyaniding, nitriding, carbon nitriding, siliconizing, or diffusion treating, is permitted by rule under 30 TAC Section 106.320.
